Dear Mr. Osburn: _.
Following up on our telephone conversation of this morning,
I have set forth below the language which will appear in the
CC&R for the Badajoz Place Condominium so that the present
owner of Unit 2 (Mr. Gelt) and his successors and assigns will
have perpetual rights of access for the purpose of maintaining and/or repairing electrical and gas installations located within Unit 1:
[Tlhe owner of Unit 1 as shown on the Condominium Plan hereby grants to the owner of Unit 2 as shown
on said plan, his successors and assigns, a right
and easement of access across and through Unit 1 for the purpose of maintaining, repairing, altering or changing gas and electrical installations and facilities which serve Unit 2, but are located within the boundaries of Unit 1. This easement is declared to be appurtenent to Unit 2.
I understand that you will be returning to your office at approxi-
mately 4:OO p.m. today. I have asked Brian Smith, my client's
engineer, to call you between 4:OO and 4:30 regarding final ap- proval and release of the parcel map. As I indicated during our
telephone conversation, it is critical that the parcel map and
condominium legal c?ocuments be recorded absolutely no later than tomorrow morning.
