Staff determination of unreasonable hardship shall be made on Form HCA-1, which shall be filed in the project file. 2. When the required work outside of the remodeled area Cl.a through l."f above) exceeds 10\ of the cost of the work to be done in the remodeled area, an unreasonable hardship shall be found to exist (criteria is staff guideline). .3. The unreasonable hardship finding may be by observation when obvious. Form HCA-1 should describe the obvious. C. REMODELS $61,000 and, HIGHER When remodels are valued over $61,000 and specific access requirements cannot b~ met: 1. The law allows ~quivalent facilities to be accepted if strict compliance with the regulations would create an unreasonable hardship. 2. Access cannot be w~ived unless there are physical or legal barriers that prevent providing either full access compliance or equivalent facilitation compliance. When both access and equivalent facilitation are waived--.by the enforcement official, ratification is required by a}, \ ..... Appeals Board. \ D. MULTI-FLOOR REMODELS: Exceptions and exemptions l. Provisions for Upper and Lower floors: The Health and Safety Code Section 19955.S says t~at,•In privately- funded multi-storied passenger vechicle service stations, shopping centers, offices of physicians and surgeons, and office buildings, subject to this code, floors or levels above and below the first floor or ground level are exempt from these requirements if a ramp or elevator is not available to provide public access to such floors or levels.• 2. C.Ompliance with Title 24 Part 2 regulations would mean demoliti0n and reoonstruction of existing restroans. The entire restaurant including the existing restrooms do meet all asi;:ects of the previous handicap code and oo allow "Equivalent Fcicilitation" to both the men's and warenis restroans. 2. This addition and ranodel is designed to accanoda.te a };based construction schedule to keep the restaurant in operation during the course of the work .• Rebuilding the restroans would dictate closure of the restaurant depriving the <:Mner of revenues. · 3.
