On November 3, 1981 our office sent a letter to your client outlining the vio- lation and requesting action by December 1, 1981. We've enclosed a copy of that letter for your files. We're also enclosing a letter from the City Building Official to your client dated August 26, 1981. Section 18.04.010 of the Carlsbad Municipal Code adopts by reference the Uni- fonn Building Code, 1979 edition, published by the International Conference of Building Officials. Section 301 of the Unifonn Building Code rrakes it unlaw- ful for any person to erect any structure without first having obtained a building pennit. Section 303 provides that the building official may in writ- ing suspend or revcke a permit whenever the permit was issued in error or on the basis of incorrect information supplied to the city or is in violation of any ordinance or regulation. The patio violates the set-baqc..,.provisions of the zoning ordinance. · Violation of the Carlsbad Municipal Code provisions are infractions. The first offense is punishable by a fine not exceeding $50. A second violation within one year is punishable by a fine not exceeding $100. The third vio- lation within one year is punishable by a fine not exceeding $250. The fourth and each additional violation within one year is a misde!reanor and is punish- able by a fine not exceeding $500 or :imprisonment for a tenn not exceeding six rronths or by both such fine in :imprisonment. Each day that the violation continues is a separate offense. Toronto, Ontario, Canada M6B3A3 RE: Maintenance of an Illegal Patio Deck--2532 La Costa Avenue The Building Official informs us that you maintain a patio deck on your property in violation of the Carlsbad Municipal Code. Maintenance of a structure, such as a patio deck, in violation of the Municipal Code is a criminal offense and also constitutes a nuisance. Each day that the structure exists is a separate violation of the code. Because the structure constitutes a nuisance, it may be abated by the city through a civil proceeding. The cost of the abatement may be charged to the owner of the property and imposed upon the property as a lien. Before instituting legal proceedings, it is our practice to conduct an office hearing to allow the property owner an opportunity to explain their violation and offer suggestions for a solution to the problem. Because you live in Canada, it would appear that conducting such a hearing would be impractical. Therefore, in lieu of a hearing, I would appreciate receiving a letter from you or your attorney, barrister or solicitor, by no later than December 1, 1981, outlining your plans to remove the patio or Bake it conform to the requirement of the Municipal Code. Your failure to comply with this ·request will leave me no choice but to initiate legal proceedings to enforce the provisions of the code. It reads as follows: "(e) Suspension or Revocation. The building official may, in writing, suspend or revoke a permit issued under the provisions of this code whenever the permit is issued in error or on the basis of incorrect information supplied, or in violation of any ordinance or regulation or any provision of this code." It has been determined that a permit was issued for an exterior patio deck based on incorrect information provided by you or your contractor. The plot plan submitted indicated a distance of 30 feet from the deck to the property line. Our inspector visited the site, determined that the plot plan was incorrectly dimensioned and noted that the deck is encroaching onto the adjacent owner's property. THE FOLLOWING ACTION IS REQUIRED TO BE TAKEN: l. Legally secure sufficient property so that there is a minimum of four feet from the existing property line. 2. Remove all portions of the deck to a distance of four feet from the existing property line. , Your building permit is hereby revoked and you are ordered to comply with either item mentioned above within sixty (60) days of this Notice and Order. Violation of the provisions of the Uniform Building Code as adopted by the city is a misdemeanor punishable upon conviction by fine, imprisonment or both fine and imprisonment.
