Gentlemen:
As a Contractor the work that we contracted for under the
above permit was completed sometime ago and our obligation
with the owner J C Penney Co. has been met.
However, there seems to be a few -items of non-compliance
that the City has found and a letter from the City was
sent to the owner. Unfortunately, we the Contractor have
no control of these non -contract items. I talked with the
Penney's people and they wish to request an extension to
get everything together, get bids and request monies from
their District to get this, work done. It will take some-
time for this so we are assisting them in requesting this
extension. We appreciate your consideration on this matter.

Our records indicate that your building permit will expire by limitation
of time on 04/05/97.
The provisions of I7-BC, Section 303(d) state: "EXPIRATION. Every permit issued
by the Building Official_ under the provisions of --this code shall expire by
limitation and become null and void if the building or work authorized by such
permit is not commenced within one calendar year from the date of such permit,
or if the building or work authorized by such permit is stopped at any time
after the work is commenced for a period -of six consecutive calendar months or
if the building or work authorized by such permit exceeds three calendar years
from the issuance date of permit. Work shall be presumed to have commenced if
the permittee has obtained a required inspection approval of work authorized
by the permit by the building official within one year of the date of permit
issuance. Work shall be presurned'to be -stopped if -the permittee has not ob-
tained a required inspection approval of work by the building official within
each six month period upon the initial commencement of work authorized by such
permit.
Before such work can be recommenced, a new permit, or a renewal permit as
specified below, shall be obtained.
1. PERMITS WHERE WORK HAS NOT COMMENCED. For permits where work has
not commenced in the first calendar year from the date of issuance, a renewal
permit may be obtained provided:
(A) No changes have been made or will be made in the original plans and
specifications for such work.
(B) That the expiration has not exceeded three years from the original
issuance date.
(C) That the same edition of the model codes is in effect as used in
the initial plan check.
(D) That a fee equal to one-half the amount required for a new permit
be paid.
The renewal permit -shall expire three calendar years from the date of initial
permit issuance.

Where later editions of the model codes have been adopted than used in the
initial plan check, such applications for renewal shall be considered as a new
plan check submittal. Accordingly, plans shall reflect the requirements of
the current codes in effect, a full new plan check is required, and a full new
plan check fee shall be paid. Upon completion of a new plan check, the permit
may be renewed upon payment of a permit fee equal to one-half the amount re-
quired for a new permit. The renewal permit shall expire three calendar years
from the date of initial permit issuance.
2. PERMITS WHERE WORK HAS COMMENCED. For permits where .work has
commenced and was subsequently stopped as defined herein, a renewal permit may
be obtained provided:
(A) No changes have been made or will be made -in' the -original plans and
specifications for such 'work.
(B) That the expiration has not exceeded three years from the issuance
date.
(C) That a fee equal to one-half the amount required for a new permit
be paid, except that where construction has progressed and has been
approved to the point of requiring only a final inspection, a fee
equal to -one -quarter the amount required for a new permit shall be
paid. A renewal permit shall expire three calendar years from the
date of initial permit issuance."
Any person holding an, unexpired permit may apply for an extension -of the time
within which he may commence work under that permit when he is unable to com-
mence work within the time required by this section for good and satisfactory
reasons. The building official may extend the time for action by the permittee
for a period not exceeding 180 days upon written request by the permittee
showing that .circumstances beyond the control of the permittee have prevented
action from being taken. No permit shall be extended more than once.

BUILDING INSPECTION DEPARTMENT GENERAL REQUIREMENTS
1. No person, firm or corporation shall erect, construct, enlarge, alter,
repair, move, improve, remove, convert, or demolish any building or
structure in the city, or cause the same to be done, without first
obtaining a separate building permit"for each such building or struct-
ute from the Building Official. Uniform Building Code Sec. 301,
Where work for which a permit -is required by this Code is started
or proceded with prior to obtaining said permit, the fee schedule
established by the city shall be doubled, but the payment of such dou-
ble fee shall not relieve any -persons from fully complying -with the re-
quirements of this Code in the execution of the work nor from any other
penalties prescribed herein. Uniform Building Code Sec. 304.
2. When the Building Official issues a permit, he shall endorse in
writing or stamp on both sets of plans and specifications
"Approved." Such approved plans and specifications shall not be
changed, modified, or altered without authorization from the
Building Official, and all work shall be done in accordance with the
approved plans. One set of approved plans and specifications shall
be returned to the applicant, which set shall be kept on such
building or work at all times during which the work authorized
thereby is in progress. Uniform Building Code Sec. 303.
3, A building permit shall expire and become null and Void if the build-
ing or work authorized by such permit is not commenced within 180
days from the date of issuance or if the building or work authorized
by such permit is suspended or abandoned at any time after the work
is commenced for a period of 180 days. Uniform Bldg. Code Sec. 303.
4. No work shall be done on any part of the building or structure
beyond the point indicated in each sucessive inspection without
first obtaining the written approval of the Building Official. Uniform
Building Code Sec. 305.
5. Whenever any building work is being done contrary to the provision
of this Code, the Building Official may order the work stopped, and
any such persons shall forthwith stop such work until authorized by
the Building Official to proceed with the work. Uniform Building
Code Sec. 202.
6. No electric wiring, devices, appliances or equipment shall be
Installed within or on any building, structure or premises nor shall
any alteration or addition be made in any such existing wiring,
devices, appliances or equipment without first securing a permit
therefor from the Inspection Department except as stated in Ord. No.
N527. in addition to any other penalty providedInthis Article for viola-
tions thereof, any person who has done any electrical work without
permit as required by this Article, or who has caused any such work
to be done without a permit, shall pay a Penalty Fee in addition to the
regular permit fee for inspection of such work.
7. No plumbing system or part thereof regulated by this Code shall be
installed within or on any building, structure, or premises, nor shall any
alteration, addition or replacement, be made in any such
existing plumbing system unless a permit therefor has first been
Issued by the inspection Department except as stated In Ord. No. 8109,
8. No heating, ventilating, air conditioning, or refrigeration system, or part
thereof shall be installed, altered, replaced, or repaired unless a per-
mit therefor has first been issued by the Inspection Department,
except as stated in Ord. No. 8108.
9. Reinspections. A reinspection fee may be assessed for each inspec-
tion or reinspection when such portion of work for which Inspection
Is called is not complete or when corrections called for are not made.
Reinspection fees may be assessed when the permit card is not pro-
perly posted on the work site, the approved plans are not readily
available to the inspection, for failure to provide access on the date
for which Inspection is requested, or for deviating from plans requir-
ing the approval of the Building Official.
In instances where reinspection fees have been assessed no addi-
tional inspection of the work will be performed until the required fees
have been paid. Excerpts from U.B.C. Sec. 305.

1. Applications for permits are processedat 2075 Las Palmas Dr. Permit
applications are not accepted via mail without prior arrangement.
The information identified in Items 2 & 3 below must be submitted at
the time of application for permit.
2. The State of California Labor Code Section 3800 mandates that no
person, owner or contractor shall employ any person, in any manner,
In conjunction with a construction project for which a permit is required
unless such employer shall first have in force a Workmen's Compen-
sation Insurance Policy.
(a) A Certificate of Insurance, as required by State Labor Code Section
3800, must be presented prior to the issuance of required permits
unless such Certificate is already on file with the Building
Inspection Department.
(b) It is extremeI important that the Certificate of Insurance be issued
to the City of Carlsbad and must contain a clause stating that in
the event the Insurance is cancelled, 10 days prior notice will be
given to the City of Carlsbad,

certificate of non -employment must be signed, and owner

3. In addition to the requirement of Item 2 of this section, it will be
necessary to provide the following Information when sdbmitting a Plan
Check Application.
(a) the legal description of the property (lot number, block number,
and name of subdivision).
(b) two plot plans, three if commercial -property, drawn to stale, which
indicate the following:
(1) shape and size (dimensioned lengths of lot boundaries) of
the property.
(2) shape and size of all buildings presently on the lot
including the proposed construction 'requested by this
permit application, and
(3) the location (dimensioned distances) of all buildings from
adjacent property line& and -from each other.
(c) Two sets of construction plans drawn to scale which clearly show
that the proposed work will conform with the requirements of the
City of Carisbad. Three sets if commercial property.
THE FOLLOWING DISCREPANCIES WERE OBSERVED DURING A
TITLE 24 HANDICAP WALK THRU OF THE STORE. THESE ITEMS
MUST BE COMPLETED IN ORDER TO OBTAIN THE FINAL
APPROVAL OF THE TENANT IMPROVEMENT.
1. Provide sign displaying the international symbol of accessibility at
every primary public entrance.
2. The lower 10" of all doors shall be smooth and uninterrupted
(entrance doors).
3. Drinking fountains required to be completely in an alcove or other
approved method projecting from encroachment into pedestrian way.
4. Public pay phone needs to comply with T-24 handicap specifications.
5. Check attached elevator specs for T-24 handicap requirements.
6. All doors require opening hardware to be lever type.
7. Water closet compartment requires a minimum 48" clearance
immediately in front of water closet.
8. Lavatory counters shall provide a minimum 29" clearance from the
floor to the bottom of the apron.
9. Restroom handicap signage required at restroom entrances. Both
T-24 and ADA signage required.
