Newly enacted legislation (AB 163 [Gog1n]), which became law an July 29,
1983, !provides builders new options and additional flexibility in complying with
the energy conservation standards for new residential buildings. The principal
features of the bill are described below:
GROUP AVERAGING Builders may comply with the standards by averaging the
performance of groups of buildings. All buildings in an averaged group must be
in the same subdivision, and all must be based on the same model. Reverse plans
and different elevations of a model are regarded as the same model. Buildings
base& on the model and with the same floorplan (including reverse plans) but
with different conservation features, such as shading, insulation levels, thermal
mass, etc, are still regarded as the same model. Different models may not be
grouped together for averaging.
builders who elect to average must apply for permits for all buildings in an
averaged group on the same day, and each application must indicate the group to
which the averaging approach is applied. The builder demonstrates compliance
by using either the Point System or any other approved calculation method, such
as CALPAS 1A or CALPAS 3, to show that a simple arithmetic average of the energy
performance of all buildings in the group meets the standards' energy budget.
When the buildings are offered for sale, builders must also notify potential
buyers that compliance with the energy standards used averaging and that the
performance of a particular home relative to the performance standard is available
upon request.
NEW PACKAGES Builders may also use new packages enacted by AB 163, in
place of Packages A, B, and C in the standards. The new packages for each
climate zone are summarized in the TABLE attached to this notice. Notes explaining
the packages appear on page 2 of this notice.
ALTERNATIVE PACKAGES AB 163 also allows builders to-develop and use their
own packages of measures, provided such packages result in the same energy
performance as the new packages in AB 163. To use this approach, builders may
use either the. Point System or another approved calculation method (e.g., CALPAS.
1A or 3) arid follow these steps:
I. Calculate the energy consumption or point system total of the building
floor an including all of the components in an AB 163 package (see attached
TABLE). Assume the building has the maximum amount of glazing allowed in that
Package and that this glazing is equally distributed north, east, south, and
west. This calculation sets the energy goal. or standard that the proposed
building must meet.
Note: If the point systemis used, this goal will not necessarily be zero
points.
2. rft the same computation, using the proposed building's actual glazing
area, orientation, and distribution, and it:i actual energy conservation features.

better than the goal established in Step 1.

OTHM PROVISIONS Of AB 163
Regardless of the method of compliance, every building must still comply with the mandatory features and devices requirements of the standards. The
requirements appear in Section 2-5352 of Title 24, CUfornip M t4V VMQPt
Any application for a building permit pending on or after July 29, 1935, may
use any of the compliance methods in AB 163 to meet the new energy standards.
If a fireplace is not located near an exterior wall, outside combustion air
is not required in climate zones 5, 6, 7, 8, 9, 10, 14, and 15. Note that this
provision of the bill is an express exemption for those climate zones from the
outside combustion air requirement in the standards. (The requirement in the
standards appears in Section 2-5352(d) of Title 24, California Administrative
Code.)
EXPLANATIONS OF THE' RUIRE?€TTS IN THE NEW AB 163 PACKAGF$ (See TABLE) The
following requirements apply if builders elect to use the packages in AB 163.
(For requirements of other packages or compliance methods, consult the standards
or the Energy Conservation Manual.)
All concrete slab floor buildings are required to have 25 percent of the
floor area directly exposed to the conditioned space. To determine the floor
area, count only the first floor in conditioned areas. Uncarpeted first floor
areas, such as linoleum or tiled entry ways, kitchens, bathrooms, and utility
closets may all be counted towards this requireiient.
In some climate, zones, a building with raised floors (rather than concrete
slab) must also include thermal mass with an area exposed to the conditioned space
equal to a.certain percentage of the ground floor floor area. The percentage for
each zone is listed in the attached TABLE. To qualify for thermal mass, the
material used must havea performance equivalent to masonry two inches thick, with
a volumetric heat capacity of 28 Btu per cubic foot per degree Fahrenheit per
hour, a thermal conductivity of one Btu per foot per foot per degree Fahrenheit
per hour, and a surface area directly exposed to the room air of the required
percentage of the ground floor floor space. A list of materials that meet these
requirements is being developed by the Commission.
The attic requirement means that an attic is installed under not less than
75 percent of the roof that is over any conditioned space.
The air conditioner efficiencies must be met if an air conditioner is
installed, but AB 163 does not require that an air conditioner be installed.
If a heat pump is used, an automatic setback thermostat is required in
climate zones 1, 3, 5, 7, 15, and 16 if building permits are applied for on or
after August 1, 1983. In all zones, an automatic setback thermostat is required
for permits applied for on or after July 1, 1984.
Infiltration barriers and air-to-air heat exchangers are not required in any
Climate zone by these packages.

The final results of tests and observations indicate that the compacted filled ground has been placed at 90 percent of the maximum dry density or greater. It has been determined that the
fill materials,, compacted to 90 percent of the maximum dry density, hczve'a safe bearing value
of at least 2000 pounds per square foot for one foot wide continuous footings founded at a mini-
mum depth and placed five feet or more I side' the top of compacted filled ground slopes. If
footings are placed closer to the exposed slopes than 5 feet inside the top of compacted filled
ground slopes, these should be deepened one foot below a 1 1/2 horizontal to 1 veffical line.
,projected outward and downward from a point 5 feet horizontally inside the top of compacted
filled ground'slopes with the two following exceptions. The exposed compacted filled ground
slopes to the rear of Lots 368 to 370, inclusive and Lots 377 to 379,. inclusive, which overlook
the golf course, contain some large boulders partially covered and partially buried. It is recom-
mended that minimum depth footings in these areas be placed no closer than 10 feet inside the top
of slope.. If it is desired to support structures closer to the top edge of these exposed slopes than
10 feet horizontally inside the top of slopes, then it is recommended that the footings be deep-
ened one foot below minimum depth for each 1.5 feet horizontal distance closer to the exposed
slopes. Tests indicate that the compacted filled ground is adequate to satisfactorily support
the proposed one or two story wood frame dwellings without detrimental settlements.
In our report of the original investigation conducted at this subdivision, (Project No. 69-9--8C
dafed November 7, 1969), we stated that some "expansive" soils existed on the site and if they
we,re allowed to remain in the upper 3 feet below finished grade some of the lots would require
J. specially designed footings and slabs. We further stated that these lots would be listed upon
the completion of grading. The lots where expansive soils were observed to remain within the
lupper 3 feet are tabulated as follows:

t is recommended that the following special design and precautions be token for the houses to
be constructed on the lots: •••
Type A Lots
1 • Avoid the Use of isolated interior piers. Use continuous footings
r throughout, and place these at a minimum depth of two feet below the
lowest adjacent exterior final ground surface
2 Reinforce and interconnect continuously with steel bars all interior and
exterior footings with one #5 bar at 3 inches above the bottom of the
footingsand one #5 bar placed .] 1/2 inches below the top of the stems
of the footings
3 Exercise every effort to assure that the soil under the foundations and stabs
has a uniform moisture content, 1 percent to 3 percent greater than optimum
throughout the top 3 feet below finished grade at the time of placing founda-
tions and slabs..
4. Use raised wooden floors that span between continuous footings, or use all
concrete stabs with. 6 x 6 ':lO/lO welded wire fabric and provide a minimum
.,of 4 inches of clean sand beneath all 'concrete stabs. Provide a moisture
barrier 2 inches below stabs under living areas.
5. Separate garage slabs from perimeter footings by ci 1/2inch thickness of con-
struction felt or equivalent, to allow independent movement of garage slobs
relative to perimeter footings.

6'. Provide positive drainage away from all perimeter footings too horizontal
distance of at least 6 feet outside the house walls.
0 Type BLots .. . . .
Those lots listed above; as Type B lots should follow all the above-listed recommendations with
the two following exceptions
1 The continuous footings may be placed at a minimum depth of 18 inches below
the lowest adjacent exterior final ground surface rather than the two feet
recommended for Type A lots.

The application must besigneci by the owner (or his authorized representative) of
the property to be 'served. The total charges must be. paid to the District at the
time the application is submitted.
If a service lateral is required, it will Oe installed by the Leucadia County Water
District. The service lateral is that part of the sewer system that extends from
the main collection line in the street (or easement) to the point in the street (at
or near the applicant's property line) where the service lateral is connected to
the applicant's, building sewer. The applicant is responsible for the construction,
at the applicant's expense, of the sewer pipeline (building sewer) from the appli-
cant's plumbing to the point in the street (or easement) where a connection is made
to the service lateral.
The connection of the applicant's building sewer to the service lateral shall he
made by the applicant at his expense. The connection must be made in conformity
with the District's specifications, rules and regulations; and IT MUST BE INSPECTED
AND APPROVED BY THE DISTRICT BEFORE THE SEWER SYSTEM MAY BE USED BY THE APPLICANT,
THE APPLICANT, OR HIS AUTHORIZED REPRESENTATIVE, MUST NOTIFY THE DISTRICT AT THE
TIME INSPECTION IS DESIRED. ANY CONNECTION MADE TO THE SERVICE LATERAL OR COLLEC-
TION LINE WITHOUT PRIOR APPROVAL AND INSPECTION BY THE DISTRICT WILL BE CONSIDERED
INVALID AND WILL NOT BE ACKNOWLEDGED.
The prorated sewer service fee is based upon the date the District estimates that
service will begin and covers the balance of the fiscal year. There will be no
additional fee or refund if service actually commences on a different date. For
