Dear Mr. Hauser:
I take exception to item #7 under dedication of requirement, where
you require me to dedicate five additional feet for the street
easement, as a condition for the approval of this wall.
As I interpret code #18.40.030, we are not constructing a building
or doing any major construction to an existing structure. All we
are doing is constructing a sea wall to protect the existing
structure from the continuous erosion from the ocean.
For the past five years I've been going through the lawful process
to build this sea wall. I've gone through comprehensive studies,
hearings and meetings with both City Planning and the California
Coastal Commission.
I have already dedicated fourteen feet to the California Coastal
Commission which will be at the base of the sea wall. I do hope
you consider deleting the requirement for the additional five feet.
At a later date, if the city enlarges the street, I would consider
consenting to your request, if it were to apply to all the
residents of Ocean Street. Otherwise, I feel as if I'm being held
hostage to something I think is illegal under the present
circumstances.

STANDARD CONDITIONS:
Notice of Receipt and Acknowledgement. The permit is not valid and
development shall not commence until a copy of the permit, signed by the
permittee or authorized agent, acknowledging receipt of the permit and
acceptance of the terms and conditions, is returned to the Commission
office.
Expiration. If development has not commenced, the permit will expire two
years from the date on which the Commission voted on the application.
Development shall be pursued in a diligent manner and completed in a
reasonable period of time. Application for extension of the permit must
be made prior to the expiration date.
Compliance. All development must occur in strict compliance with the
proposal as set forth below. Any deviation from the approved plans must
be reviewed and approved by the staff and may require Commission approval.
Interpretation. Any questions of intent or interpretation of any
condition will be resolved by the Executive Director or the Commission.
Inspections. The Commission staff shall be allowed to inspect the site
and the development during construction, subject to 24-hour advance notice.
Assignment. The permit may be assigned to any qualified person, provided
assignee files with the Commission an affidavit accepting all terms and
conditions of the permit.
Terms and Conditions Run with the Land. These terms and conditions shall
be perpetual, and it is the intention of the Commission and the permittee
to bind all future owners and possessors of the subject property to the
terms and conditions.
SPECIAL CONDITIONS:
The permit is subject to -the following conditions:
1. Revised Plans. Prior to the issuance of the coastal development
permit, the applicant shall submit for the review and written approval of the
Executive Director, revised final site, building, foundation and grading
plans, approved by the City of Carlsbad. The plans shall incorporate the
following:
a. Said plans shall comply with all recommendations contained in the
geotechnical report for the project, by Hetherington Engineering, Inc.,
dated July 25, 1990.

b. No portion of the proposed seawall shall extend to an elevation higher
than that of the seawall on the adjacent property ot the south (2611-2679
Ocean Street), or 18.5 feet MSL, as indicated in the topographic survey
dated July 1990 and as indicated on plans approved by the Commission in
conjunction with COP #6-86-585 (Grosse & Mooney). No portion of any
proposed planter, retaining wall, decking, spa or other visually opaque
structure shall -extend to a height greater than the corresponding wall
located five (5) feet behind the seawall on the property to the south, as
indicated on the approved plans, i.e. in no event shall any such structure
extend more than four (4) feet above the height of the approved seawall.
Windscreens or fencing that do not provide a visual obstruction shall be
allowed to a maximum of three (3) feet above the allowed deck level as
specified above.
Assumption of Risk. Prior to the issuance of the coastal development
permit, the applicant shall execute and record a deed restriction, in a form
and content acceptable to the Executive Director, which shall provide: (a)
that the applicant understands that the site may be subject to extraordinary
hazard from bluff retreat and erosion, and the (b) applicant hereby waives any
future claims of liability against the Commission or its successors in
interest for damage from such hazards. The document shall run with the land,
binding all successors and assigns, and shall be recorded free of prior liens.
Future Development. Prior to the issuance of the coastal development
permit, the applicant shall execute and record a document, in a form and
content acceptable to the Executive Director, stating that the subject permit
is only for the development described in the coastal development permit No.
6-92-107; and that any future additions or improvements to the principal
residence, or accessory structures, other than herein approved; or other
development as defined in Public Resources Code Section 30106 will require an
amendment to permit No. 6-92-107 or will require an additional coastal
development permit from the California Coastal Commission or from its
successor agency. The document shall be recorded as a covenant running with
the land binding all successors and assigns in interest to the subject
property.
Lateral Access. Prior to the issuance of the coastal development
permit, the landowner shall execute and record a document in a form and
content acceptable to the Executive Director, irrevocably offering to dedicate
to a public agency or private association approved by the Executive Director
an easement for lateral public access and passive recreational use -along the
shoreline. The document shall provide that the offer of dedication shall not
be used or construed to allow anyone, prior to acceptance of the offer, to
interfere with any rights of public access acquired through use which may
exist on the property.

SPECIAL CONDITIONS, continued:
Such easement shall be located along the entire width of the property from the
western property line to the toe of the seawall. The recorded document shall
include legal descriptions of both the applicant's entire parcel and the
easement area. The document shall be recorded free of prior liens and any
other encumbrances which the Executive Director determines may affect the
interest being conveyed. The offer shall run with the land in favor of the
People of the State of California, binding all successors and assignees, and
shall be irrevocable for a period of 21 years, such period running from the
date of recording.
Landscaping Plan. Prior to the issuance of the coastal development
permit, the applicant shall submit a detailed landscape plan indicating the
type, size, extent and location of all plant materials, the proposed
irrigation system and other landscape features. Drought and salt tolerant
plant materials shall be utilized to the maximum extent feasible. Special
emphasis shall be placed on the treatment of walls, fences or other structures
in the sideyard setback and landscaping in the sideyard setback to maintain
views through these areas, with no visual barriers higher than three feet from
adjacent grade level allowed in the area of the sideyard setbacks parallel to
Ocean Street. Said plan shall be submitted to, reviewed and approved in
writing by the Executive Director.
Fill Material. Prior to the issuance of the coastal development
permit, the applicant shall identify the location of the borrow site for fill
materials. If the site is-located within the coastal zone, a separate coastal
development permit or permit amendment shall first be obtained from the
California Coastal Commission or its successors in interest.
Maintenance Activities/Future Alterations. The property owner shall
be responsible for maintenance of the permitted protective device. Any change
in the design of the project or future additions/reinforcement of the seawall
will require a coastal development permit. If after inspection, it is
apparent that repair or maintenance is necessary, the applicant(s) shall
contact the Commission office to determine whether permits are necessary. The
applicants shall also be responsible for the removal of debris deposited on
the beach or in the water during or after construction of the shoreline
protective device or resulting from failure of the shoreline protective device.
Construction Materials. Disturbance to sand and Intertidal areas
shall be minimized. Beach sand excavated shall be redeposited on the beach.
Local sand, cobbles or shoreline rocks shall not be used for backfill or
construction material.
Construction Schedule. Prior to the issuance of the coastal
development permit, the applicant shall submit a construction schedule which
demonstrates that all work which requires access on the beach by construction
vehicles or equipment shall occur either before Memorial Day weekend or after
Labor Day of any year.

10. 'Construction Access/Staging Areas. Prior to the issuance of the
coastal development permit, the applicant shall submit final plans, approved
by the City of Carlsbad, for the review and written approval of the Executive
Director. Said plans shall show the construction methods and construction
access to the site; the plans shall also show areas where construction
materials will be stored and construction activities staged. Construction
storage and staging areas shall not be allowed on the beach or the vertical
access adjacent to the north. Existing street parking areas shall not be used
for the storage of construction materials.
11. Community Wide/Regional Solution to Shoreline Erosion. Prior to the
issuance of the coastal development permit, the permittee(s) shall execute and
record a deed restriction, which shall provide that the permittee(s), or
successor-in-interest, shall agree to participate in the implementation of any
comprehensive program contained in the City's certified Local Coastal Program
(LCP) addressing a community-wide/regional solution to the shoreline erosion
problems in Carlsbad. The permittee(s), or successor-in-interest, also agree
to participate in any assessment district or other means to implement the
LCP's solution to the shoreline erosion problems.
The responsibility of participation in the community-wide/regional solution
shall rUn with the land binding on the property owner's successors and assigns
and the above parameters shall be documented in a recorded restriction against
the deed of the subject property. This restriction shall be recorded, in a
form and content acceptable to the Executive Director and shall be recorded
free of prior liens or encumbrances, other than tax liens, which the Executive
Director believes may affect the interest being conveyed. Evidence of
recordation of this restriction shall be submitted to and acknowledged in
writingby the Executive Director prior to the issuance of the coastal
development permit.
12. Storm Design. Prior to the issuance of the coastal development
permit, the applicants shall submit certification by a registered civil
engineer, acceptable to the Executive Director, that the approved shoreline
protective device is designed to withstand storms comparable to the winter
storms of 1982-83. Said certification shall be subject to the review and
written approval of the Executive Director.
Within 60 days following the completion of the project the applicants shall
submit certification by a registered civil engineer, acceptable to the
Executive Director, verifying that the seawall has been constructed in
conformance with the final approved plans for the project.

13. State Lands Commission Review. Prior to the issuance of the coastal
development permit,, the applicant shall obtain a written determination from
the State Lands Commission that:
No State lands are involved in the development; or,
State lands are involved in the development, and all permits
required by the State Lands Commission have been obtained; or,
C. State lands may be involved in the development, but pending a
final determination, an agreement has been made with the State
Lands Commission for the project to. proceed without prejudice to
that determination.

the bedrock contact to be at E..+ 5.0 ()iSL). Scour
should be considered to be El,+4,0 (MSL). Samples
of the exposed bedrock were obtained for laboratory
testing. Unconfined compression tests indicated
uncofined compressive strengths in the bedrock of
12,500 pounds per square foot and 2,100 pounds per
square foot and direct shear testing of a remolded
sample of the bedrock indicated an angle of
