The application must be signed by the owner (or his authorized representative) of
the property to be served. The total charges must be paid to the District at the
time the application is submitted,
If a service lateral is required, it will be installed by the Leucadia County Water
District. The service lateral is that part of the sewer system that extends from
the main collection line in the street (or easement) to the point in the street {.at
or near the applicant's property line) where the service lateral is connected to
the applicant's building sewer. The applicant is responsible for the construction,
at the applicant's expense, of the sewer pipeline (building sewer) from the appli-
cant's plumbing to the point in the street (or easement) where a connection is made
to the service lateral.
The connection-of the applicant's building sewer to the service lateral shall^be
made by the applicant at his expense. The connection must be made in conformity
with the District's specifications, rules and regulations; and IT MUST BE INSPECTED
AND APPROVED BY THE DISTRICT BEFORE THE SEWER SYSTEM MAY BE USED BY THE APPLICANT,
THE APPLICANT, OR HIS AUTHORIZED REPRESENTATIVE, MUST NOTIFY THE DISTRICT AT THE
TIME INSPECTION IS DESIRED, ANY CONNECTION MADE TO THE SERVICE LATERAL OR COLLEC^
TION LINE WITHOUT PRIOR APPROVAL AND INSPECTION BY THE DISTRICT WILL BE CONSIDERED
INVALID AND WILL NOT BE ACKNOWLEDGED.
The prorated sewer service fee is based upon the date the District estimates that
service will begin and covers the balance of the fiscal year. There will be no
additional fee .or refund if service actually commences on a different date. For
succeeding fiscal years, the sewer service fee will be collected on the tax roll
in the same manner as property taxes.

Gentlemen :
When visiting your office this afternoon, I found that
we still have not been issued a completion notice on our building,
Apparently, a letter mailed you last June 10th, from the B0nton
Engineering, Inc., regarding the inspection of the drainage ex-
isting at our site, was either never received by your department
or displaced.
At Mr, Bd Green's request, we called in the Benton Engin-
eering Conpany for an OK on our drainage - which seemed to be the
item in question holding up our completion notice. A copy of their
letter is enclosed and should be all that is needed to end this -
delay.

Dear Mr. Wiike:
This is to report the results of our inspection of the drainage conditions existing at the
subject site on June 18, 1980.
H is concluded that the areas adjacent to the house have been graded in accordance with
the recommendation presented in our report on Project No. 71-3-24D, dated September 10,
1973, i.e., having a vertical fall of ot least 5 inches in a horizontal distance of 5 feet. The
swales around the perimeter of the house were also deferminea1 fo hove sufficient gradients
to direct the runoff to suitable discharge crecs.

Per our telephone conversation, I have researched City records and verified
that the future improvement agreement along your property is still in
effect. (A copy of this contract is attached).
I'm very sorry for the delay in installing the sidewalk. The Wilkes have
indicated (per telephone conversation) that they would have to delay
construction for a few weeks until their new house is built. No additional
news has been received to this date.
Thank you for your patience in this matter.

City not being fair about sidewalks
This letter is being written by for-
mer residents of Carlsbad, who lived
for 44 months at 2670 Cazadero Drive
in the Meadows No 4 area of La
CosCa
We applied for permission to build
this home in 1978 but before the city
of Carlsbad would issue us a building
permit they made us sign a document
which became a lien on the property
that if and when at a later date the
cit> decided they wanted to put side
walks m this area that we would be
held liable to pa> for installing the
sidewalk m front of our property
The Meadows No 4 area of La Cos
ta had been developed 15 years earl
icr and the original developers nev-
er intended the area to have side-
« aJks as it was to be in the character
of an exclusive estate area The lots
are large all being at least three
quarters of an acre with wide fron-
tages The original developers in
order to keep this character, planted
Monterey pine trees and Eucalyptus
trees onlj three feet from the curb-
ing allowing no space for the five foot
sidewalks the citv of Carlsbad is now
requiring to be installed there
When we, as former owners of 2670
Cazadero Drive sold the home last
November, the new owners disco-
vered this lien on the property and
refused to close the deal until we
agreed to take the responsibility of
installing the walk Since we felt the
building of the sidewalk which ne
cessitated removal of two lovely
large pine trees as well as all land
scaping the w idth of five feet, would
destroy the beautj of the street, we
agreed to finish closing the property
deal by puttmg'up a bond to pay for
the future installation of the side
walk
We have still at this date five
months later refused to put up the
bond because we found, upon inves
tigation, that the city of Carlsbad
made two bad mistakes Firstly —we
were discriminated against since
two builders of homes built after
ours — in the same block — were not
required to sign any agreement
which became a lien on their proper-
ty— but were given a building permit
when the> needed it Is this not un-
fair discrimination' Secondly — be
cause of the unfair and costly need
for all homes already built in that
area to have the trees and all their
expensive landscaping removed in
order to p^it in a sidewalk, for they
will get the order whether they have
a lien against then; property or not1
There are many lots on these
streets that have not been built on
and it likely wilt be years before any
homes are built on them as some are
exceedinglv sleep which of course,
means that a spottj non-continuation
of sidewalks will occur an on
again off again affair, not conducive
to joggers or pedestrians' And ugly,
at best with weeds growing waist-
high in between
In early February 1984 we had a
conference with the Carlsbad city
manager about this ben on the title
and the manager said that the city
had made a mistake when this was im
posed upon us and promised he
would do all he could to get the mis
take rectified Several weeks later
the matter was presented to the City
Council and our plea was rejected by
four of the five council members, in
eluding the mayor Only the council
woman from La Costa, Ann Kulchm,
voted in our favor
Homeowners in that area of La
Costa dnve on the streets, there is
very little walking, it is very hilly,
and is too far from any shopping
plazas, yet as an example of discri-
mination, why is not Highland Ave-
nue, for instance, required to have
sidewalks where many children walk
to nearby schools or to the magnifi-
cent library'
It is only necessary to drive along
Cazadero Drive, and up onto the
street above to see what the area
would look Jike without those lovely
— and large — pine and eucalyptus
trees and the handsome and expen-
sive landscaping right up to the curb-
ing Isn't it time for those owners to
get together and get this ridiculous
demand stopped' And what will
Alga Road — that lovely, long and
curving roarf — look like wjfh all
those trees removed in order to put
in the 5-foot sidewalk'
Regardless of whether other prop-
erty ow ners in the La Costa area join
with us in fighting this ugly and
grossly unfair policy of the city in de
mending the installation of little
strips of sidewalk one at a time, at
enormous cost to property owners,
we, the undersigned will continue
our fight for a fair and honest deal
from the city of Carlsbad
If necessary, we may carry our fight
into the courts where we are certain
that we will get justice from a judge
and a jury We also intend to discuss
our problem with the American Civil
Liberties Union

Recently, 1 saw a small article
which noted the frequency with
which large scale construction proj
ects are being approved by the city
cf_Carlsbad Although personal
health concerns make it impossible
for mp to participate in any more
political campaigns in Carlsbad, I
feel 1 must speak out one more time
about this matter
The successful candidate for pub
he office in a small town like Carls
bad spent between ten and fifteen
thousand dollars to run for an office
that pays a few hundred dollars per
month The reason I know is because
the information is available upon re
quest at the City Clerk s office Any
citizen may go to the City Clerk's
office and review the reported ex
penditures of the candidates
What is even more disturbing is
that the successful candidate for
public office m a small town like
Carlsbad received generous finan-
cial support from organizations out-

get involved in a small town election
Sadlv, the election process has be
come a modern-day slave auction
with the successful candidates being
the ones who can win the backing of
the most wealthy and influential big

cessful candidate for public office
will give in return for this backing
I urge you to consider that there is
a connection between the patterns of
these local elections and projects
that are later approved by the local
government
Even if this is not technically illeg-
al, it appears to be a conflict of in-
terest to me
How can average citizens change
the pattern of these local elections''
Perhaps you would consider a mea
sure to place an expenditure limit on
these local elections I did this in the
1982 election in Carlsbad I urged
that a $2,500 spending limit be
placed on campaign expenses for the
Carlsbad Citv Councils lection Sure
month I thought so The successful
candidate for public office in a small
town like Carlsbad did not agree I
lost He won
You can have some influence on
the final outcome of these local con
tests if you are willing to get in-
volved Find people to run for public
office that have no ties to the de
velopers who seek permits from the
city government Back them with
your time and your involvement in
attending meetings knocking on
doors, and making phone calls This
type of involvement on your part can
ensure that candidates other than
those backed by the out-of-town in-
terests have a decent chance to com-
pete against the big boys. Your lack of
involvement only perpetuates the
slave auction quality of these impor-
tant local races And when you see
your town become more like Los
Angeles, with increased traffic prob-
lems increased noise and increased
pollution, if you do not become in-
volved, you will have no one to blame

SIDEWALK ALONG PROPERTY FRONTAGE OF 2670 CAZADERO DRIVE
Construction of the sidewalk along your property frontage is
scheduled to begin within 3-4 weeks (rough estimate). At your
request, the sidewalk will not meander around the pine trees,
instead the trees will be removed. (These trees may have already
been cut by the time you receive this letter). The rest of the
existing landscaping adjacent to the curb and gutter must be
removed, including your mailbox and walkway. Please schedule a
Contractor to move or relocate these i terns within 5-1/2 feet
behind the curb and gutter. Neither the City nor the Contractor
can be held responsible for private property within the public
right-of-way, so please have these items removed so as not to
cause conflict or damage to root systems or materials.
Hopefully, once this construction has begun, it will take just
a few days (less than a week to complete).

THIS AGREEMENT is made by the City of Carlsbad, a municipal
corporation, hereinafter referred to as "C;ty'r, and Elmer V. Wilke and
Dorothy D. Wilke, husband and wife as J01nt ^Ter^inafter referred to as "Proper-
ty Owner".
RECITALS-
WHEREAS, Property Owner has applied to City for a
BUILDING PERMH (PLAN CHECK No. 79-119 _)
for the real property hereinafter descrjoed, now under Property Owner's
ovnership; and
WHEREAS, it has beer- found trst said p-operty is not suitable
for development in its present condition, however said property would be
suitable for development if certain public improvements hereinafter
described are constructed and certain irrevocable offers of dedication
are made to City; and
WHEREAS, the Municioal Code of City Chapter 18.40
requires certain improvements and dedications as a condition of approval
of this Building Permit

' WHEREAS, Property Owner, in consideration of the approval of

/ to be in the public interest to agree to temporarily postpone said

MOW, THEREFORE, IT IS AGREED between the parties hereto as
follows:
/ Sect ion 1. That City agrees to record any irrevocable offers
of dedication made by Property Owner for said Building Permit
-. (Plan Check No. 79-119 ).
Section 2. That Property Owner, in lieu of making the herein-
after described improvements before approval of said Building Permit
is granted, agrees to install and construct, or cause to be installed
or constructed, said improvements in accordance with plans and specifi-
cations approved by the City Engineer within 60 days after written
demand so to do by City. Property Owner shall not be required to make
said improvements before January 1, 1981 or within such further period
of time as is granted by City, provided, however, that upon the happening
of either of the following occurrences said improvements may, at the sole
election of City, be reauired to be made sooner than said date or such
extended period of time which may have been granted by City: -
(a) When the City Council "finds that the owners of kO% or more
of the frontage, i nclud ing the frontage of Property Owner, between i nter-
sect i ng streets on both sides of the st reet upon whIch the property herei n
.described has frontage, have agreed with City to install street improve-
ments to City specifications.
(M When owners of more than 50% of the frontage, between
intersecting streets on both sides of the street upon which the property
herein described has frontage, have petitioned the City to form an
improvement district for the improvement of sa id streets.
Said improvements shall be made without cost or expense to
City. City estimates that the cost of engineering and construction of
sa id improvements at the time of signing this contract i s $1,890.00
Property Owner hcreb/ acknowledges that said cost ts a reasq«eb'e
estimate of engineering and construction costs at this time and that the
actual cost of same at some time in the future may exceed this estimate.
Sect ion 3. That for the faithful performance of the promises

covenants herein contained, Property Owner hereby grants to City a
upon the hereinafter described property in the amount of $1,890.00
jus any future Increases cf cost in excess of this sum resulting from
,ncrea^ed engineering and construction costs, and in the event Property
Owner, his successors, heirs, assigns, or transferees fail to install
and construct said improvements in the manner and within the time speci-
fied herein, he agrees that City may do any or all of the following.

(a) Have the necessary engineering for said improvements
clone, and \ nsta 11 and construct sa id improvements by cont ract or other-
wise. City or its contractor and his employees may enter upon any
portion or portions of the property reasonably necessary for said
engineering and construction, and the entire cost and expense shall be
charged against said property and payable by said Property Owner, his
successors, heirs, assigns, or t ransferees immed iately upon complet ion
of said improvements. In the event same is not paid within 30 days from
completion, City may foreclose said lien as provided by law for the
foreclosure of mortgages.
(b) Direct the City Engineer to estimate the cost of necessary
engineering end the work required to install and construct sa r.d improve-
ments, and foreclose said lien in said amount.
(c) Pursue any remedy, legal or equitable (including those
specifically referred to herein), for the foreclosure of a Men, and the
Pioperty Owner, his successors, heirs, assigns, and transferees, shall
be liable for reasonable attorney's fees as a cost In said proceed i ngs.
Section U. That it is agreed that anything herein contained to
the contrary notwithstanding, the promises and covenants made herein shall
not be binding upon the holders, mortgagees, or beneficiaries of any
purchase money mortgage or purchase money deed of trust for value which
has been or may in the future be executed by the Property Owner, his
successors, heirs, assigns, or transferees, and the lien hereby created
shall be and is hereby subordinated to and declared to be inferior and
subsequent in lien to the lien of any such purchase money mortgage or
purchase money deed of trust. The lien hereby created shall likewise be
of no force or effect against any owner whose title to the property here-
inafter described is acquired by or as a result of a foreclosure or

Sect ion 5. That at any time during the period herein provided,
Property Owner, his successors, heirs, assigns, or transferees may
deposit a cash bond or post a surety performance bond satisfactory to
the City to charge said surety with the cost of satd improvements; the
amount of bond to be the estimated cost of engineering and improvements
at the time of such deposit or posting as ascertained by the City Engineer,
and that upon deposit of said cash or posting of said bond the City%
agrees to release the property, or any portion of it as to which said
deposit or posting applies, from the provisions of this agreement, and
to execute any necessary release to enable the record title of the pro-
perty to be released from the lien herein imposed.
Sect Jon 6. Sa i d City sha11 not, nor shal1 any officer or

employee thereof, be liable or responsible for any accident, loss or

damage happening or occurring to the work or improvements specified in
this agreement prior to the completion and acceptance of the same, nor
shall said City, nor any officer or employee thereof, be liable for
any persons or property injured by reason of said work or improvements,
but all of said liabilities shall be assumed by said Property Owner, and
h i s successors , 'hei rs , ass igns, and transferees, and they sha 11 save the
City harmless from, and indemnify the City against, any and all claims,
suits and liabilities of or to any person or property injured or claim-
ing to be injured as a result of said work or improvements. Said Pro-
perty Owner, and his successors, heirs, assigns, and transferees, further
agrees to protect said City and the officers and employees thereof from
all liability or claim because of, or arising out of, the use of any
patent or patented article in the construction of said improvements.
Section 7. It is further agreed that said Property Owner will
at all times up to the completion and acceptance of said work and im-
provements by the City, give good and adequate warning to the traveling
publi c of any dangerous or defect ive cond i ti ons of publi c property. The
Property Owner hereby agrees to pay for such inspection of improvements
as may be required by the City Engineer of City.
Sect ion 8. This agreement and the covenants contained herein
shall be binding upon and inure to the benefit of the successors, heirs,
