property or not1 There are many lots on these streets that have not been built on and it likely wilt be years before any homes are built on them as some are exceedinglv sleep which of course, means that a spottj non-continuation of sidewalks will occur an on again off again affair, not conducive to joggers or pedestrians' And ugly, at best with weeds growing waist- high in between In early February 1984 we had a conference with the Carlsbad city manager about this ben on the title and the manager said that the city had made a mistake when this was im posed upon us and promised he would do all he could to get the mis take rectified Several weeks later the matter was presented to the City Council and our plea was rejected by four of the five council members, in eluding the mayor Only the council woman from La Costa, Ann Kulchm, voted in our favor Homeowners in that area of La Costa dnve on the streets, there is very little walking, it is very hilly, and is too far from any shopping plazas, yet as an example of discri- mination, why is not Highland Ave- nue, for instance, required to have sidewalks where many children walk to nearby schools or to the magnifi- cent library' It is only necessary to drive along Cazadero Drive, and up onto the street above to see what the area would look Jike without those lovely — and large — pine and eucalyptus trees and the handsome and expen- sive landscaping right up to the curb- ing Isn't it time for those owners to get together and get this ridiculous demand stopped' And what will Alga Road — that lovely, long and curving roarf — look like wjfh all those trees removed in order to put in the 5-foot sidewalk' Regardless of whether other prop- erty ow ners in the La Costa area join with us in fighting this ugly and grossly unfair policy of the city in de mending the installation of little strips of sidewalk one at a time, at enormous cost to property owners, we, the undersigned will continue our fight for a fair and honest deal from the city of Carlsbad If necessary, we may carry our fight into the courts where we are certain that we will get justice from a judge and a jury We also intend to discuss our problem with the American Civil Liberties Union Mr and Mrs Elmer Wiike San Marcos Protect city from out-of-town interests Recently, 1 saw a small article which noted the frequency with which large scale construction proj ects are being approved by the city cf_Carlsbad Although personal health concerns make it impossible for mp to participate in any more political campaigns in Carlsbad, I feel 1 must speak out one more time about this matter The successful candidate for pub he office in a small town like Carls bad spent between ten and fifteen thousand dollars to run for an office that pays a few hundred dollars per month The reason I know is because the information is available upon re quest at the City Clerk s office Any citizen may go to the City Clerk's office and review the reported ex penditures of the candidates What is even more disturbing is that the successful candidate for public office m a small town like Carlsbad received generous finan- cial support from organizations out- eirtp fif tho ,.,.„ .ro.^lchnH the citv ofCarlsbsd wouJd bother to get involved in a small town election Sadlv, the election process has be come a modern-day slave auction with the successful candidates being the ones who can win the backing of the most wealthy and influential big shots Onemuslwonderwhatthesuc cessful candidate for public office will give in return for this backing I urge you to consider that there is a connection between the patterns of these local elections and projects that are later approved by the local government Even if this is not technically illeg- al, it appears to be a conflict of in- terest to me How can average citizens change the pattern of these local elections'' Perhaps you would consider a mea sure to place an expenditure limit on these local elections I did this in the 1982 election in Carlsbad I urged that a $2,500 spending limit be placed on campaign expenses for the Carlsbad Citv Councils lection Sure month I thought so The successful candidate for public office in a small town like Carlsbad did not agree I lost He won You can have some influence on the final outcome of these local con tests if you are willing to get in- volved Find people to run for public office that have no ties to the de velopers who seek permits from the city government Back them with your time and your involvement in attending meetings knocking on doors, and making phone calls This type of involvement on your part can ensure that candidates other than those backed by the out-of-town in- terests have a decent chance to com- pete against the big boys. In the event same is not paid within 30 days from completion, City may foreclose said lien as provided by law for the foreclosure of mortgages. (b) Direct the City Engineer to estimate the cost of necessary engineering end the work required to install and construct sa r.d improve- ments, and foreclose said lien in said amount. (c) Pursue any remedy, legal or equitable (including those specifically referred to herein), for the foreclosure of a Men, and the Pioperty Owner, his successors, heirs, assigns, and transferees, shall be liable for reasonable attorney's fees as a cost In said proceed i ngs. That it is agreed that anything herein contained to the contrary notwithstanding, the promises and covenants made herein shall not be binding upon the holders, mortgagees, or beneficiaries of any purchase money mortgage or purchase money deed of trust for value which has been or may in the future be executed by the Property Owner, his successors, heirs, assigns, or transferees, and the lien hereby created shall be and is hereby subordinated to and declared to be inferior and subsequent in lien to the lien of any such purchase money mortgage or purchase money deed of trust. The lien hereby created shall likewise be of no force or effect against any owner whose title to the property here- inafter described is acquired by or as a result of a foreclosure or (3) 1474 purchase money mortgaged? purchase money Sect ion 5. That at any time during the period herein provided, Property Owner, his successors, heirs, assigns, or transferees may deposit a cash bond or post a surety performance bond satisfactory to the City to charge said surety with the cost of satd improvements; the amount of bond to be the estimated cost of engineering and improvements at the time of such deposit or posting as ascertained by the City Engineer, and that upon deposit of said cash or posting of said bond the City% agrees to release the property, or any portion of it as to which said deposit or posting applies, from the provisions of this agreement, and to execute any necessary release to enable the record title of the pro- perty to be released from the lien herein imposed. It is further agreed that said Property Owner will at all times up to the completion and acceptance of said work and im- provements by the City, give good and adequate warning to the traveling publi c of any dangerous or defect ive cond i ti ons of publi c property.
