Materials and Special Reurements. The fill soils shall consist of s e l e c t m a t e r i a l s s o g r a d e d 'that at least 40 percent of material passes a No.-4 sieve. This may be obtained from the excavation of banks, borrow pits of any other approved sources and b y m i x i n g s o i l s f r o m one or more sources'. The material uses shall be free from vegetable matter, a n d o t h e r d e - leterious substances, and shall not contain rocks or lumps of greater t h a n . 6 i n c h e s i n d i a m e t e r . Placing, Spreading, and Cornpqcting,Fill Materials. ' The suitable fill material shall he placed in layers which, when compacted s h a l l -not exceed six inches (6"). Each layer shall he spread eve:nly and shal l b e t h o u g h l y mixed during-the spreading to insire uniformity of materl and moisture in 'each 'lay e r . When the moisture content of the fill maferial'is' below that specified by the soils engin e e r , water shall be added until the moisture' content is near optimum as specified by 'the soils engineer to assure thorough bonding during the compacting process. When the moisture content of the fill material is above that specified b y t h e s o i l s engineer, the fill-material shall be aerated by blading and scarifying or ot h e r s a t i s - factory methods until the moisture content is near optimum as specif i e d b y t h e s o i l s . engineer. (d); After each layer has been placed, mixed and spread evenly, it shall b e t h o r o u g h l y compacted to not less than' ninety, percent of maximum density in accordance with A.S .T..M. D-1557-70 modified as described in 2 (d),above. Field density tests shall be taken by the soils engineer for approximately each foot In elevation gain after compaction, but not to exceed two feet in vertical heigh t between tests. Seasonal 'Limit's. Two next door neighbour's properties along, with ours on 2706 Galicia Way, Carlsbad, were severely damaged during the heavy rain storms in last February, '1980. 'Mr. & Mrs.. Carlsmalléy's and our properties were inspected by-. Mr. Philip Benton, Benton Engineering, Inc., and subsquently, a preliminary repair plan was made (See attachment). It is .showr in the proposed repair plan, Lots 260, 261 'and 90 of the La Costa South Unit No.14 were damaged and have to be repaired. I called the owner of Lot 90, Mr. and Mrs. Dalegdig, and in- formed them about the damage of their lot. Mr. and Mrs. Daleg- dig did not concern much-about-the damage and alo indicated that the building permit would be obtained soon, . and that their relative, Mr. Edwin I. Quebada, would be in chargé the building ,construction -activities. Both Mi. Benton and I called Mr0 Quebáda and tried to explain.-to him the Severity of the damage of Lot 90,: and :it would be unwise. to build a house on such. 'a lot before it is properly repaired.' Finally a meeting was held on the damaged site, Lots 90 and 260, at Galicia Way on May 16, 1980. The attendants of the meeting were Mr. Philip Benton, Mr. Bud Beattia (Benton Engineering, Inc.), Mr. Quebada,'Mr. and Mrs. Carl Smalley, and myself. At the meeting, Mr. Quebada agreed to repair the cement ditch only, but not the lot. I could not convince him to repair the lot for their best interest as well as for ours. For the past few weeks, a number of construction contractors came to 'estimate the cost of the job. ' They all pointed out that our lot, Lot 260 may still have problem even after it is re- paired unless Lot 90 is also repaired. In the last two weeks, loose dirt has been shipped In and dumped into Lot 90. Yesterday, a construction contractor pointed out to me that the dirt pile in Lot 90 has been dumped illegally. It dumped''right on the top'of bushes and vegetatlona, and the damaged part of the lot has not been repaired.' If Lot 90 is continuously to be filled up, the dirt pile will be on the bank of our lot, Lot 260. With this condition, if a heavy rain storm comes, the loose dirt pile will be collapsed, it may also endanger to our lot or even to the house. We have already provided Mr. Quebada a proposed repair plan of his lot, Lot 909 at no cost to him. Furthermore, in the future, we would provide Mr. Quebada the information of the soil test and a detailed repair plan which would cost us about $ 8,000.00, but 'again it will, be no cost to him. In exchange, wedb:need his co- operation as followsz Repair their own lot, Lot 90. No more illegal dumping of the loose dirt. The toe of the "dirt pile on Lot 90 should not' be on-the bank of Lot 260,, except it is proposed by the soil engineering company. Provide us access during the soil test holes boring and repairing. For the best interest of all of use Mr. Quebada should joint us to have a master repair plan made, it would cost him almost no- thing, and also, he will have the advantage on the price to have -2- -•4*••• • r Picture.(3) shows the dirt pile on the bushes and vegatatlon. Picture (3) I read an article dated June 17, 1980. on Blade Tribune. It Quoted the statement made by the city engineer Lea Evanss "The Housing development in parts of La Costa and other areas of the city would never be built the same way, thanks to new grading and soil testing requirements adopted by the city since those developments have been built." I wonder if Lot 90 has ever com- plied of those new, requirements adopted by the city. The tentative date for our test holes boring by Benton Engi- neering Inc. has been set at the middle of July, therefore, we need your help to direct the owners of Lot90 to comply the re- gulations and provide us the access during the test holes boring and repairing.
