We thought you should be kept informed as to the progress of the permit process for
McLain Properties at the above address.
To date Mr. Craig Ruiz, of the City of Carlsbad Housing and Redevelopment
Department has assisted us in garnering information on Area 9 of the Carlsbad Village
Master Plan and Design Manual. It appears mat this particular project very likely fells into
what the Redevelopment Department and the California Coastal Commission want for the
area because of its tourist and beach orientation. Our main problem at this point is that real
estate brokers are specifically prohibited yet this license is required in order to do beach
rentals even though real estate itself ia not being sold through this office.
A detailed and complete Redevelopment Guideline and a Village Master Plan and
Design Manual is now being requested from the Carlsbad City Housing and
Redevelopment Department. Also A detailed guideline with a complete master plan
manual from me California Coastal Commission is being requested along with their intend
for usage in Area (of the City of Carlsbad.
At this point we are extremely optimistic about the results and hope you'll bear
with us during mis part of the project.

This plan review is limited to the technical requirements contained in the Uniform Building
Code, Uniform Plumbing Code, Uniform Mechanical Code, National Electrical Code and state
laws regulating energy conservation, noise attenuation and access for the disabled. This plan
review is based on regulations enforced by the Building Department. You may have other
corrections based on laws and ordinances enforced by the Planning Department, Engineering
Department, Fire Department or other departments. Clearance from those departments may be
required prior to the issuance of a building permit.
Code sections cited are based on the 1994 UBC.
The following items listed need clarification, modification or change. All items must be satisfied
before the plans will be in conformance with the cited codes and regulations. Per Sec. 106.4.3,
1994 Uniform Building Code, the approval of the plans does not permit the violation of any
state, county or city law.
To speed up the recheck process, please note on this list (or a copy) where each
correction item has been addressed, i.e.. plan sheet number, specification section, etc.

• GENERAL
Please make all corrections on the original tracings, as requested in the
correction list. Submit three sets of plans for commercial/industrial projects (two
sets of plans for residential projects). For expeditious processing, corrected sets
can be submitted in one of two ways:
1. Deliver all corrected sets of plans and calculations/reports directly to the City
of Carlsbad Building Department, 2075 Las Palmas Drive, Carlsbad, CA 92009,
(619) 438-1161. The City will route the plans to EsGil Corporation and the
Carlsbad Planning, Engineering and Fire Departments.
2. Bring one corrected set of plans and calculations/reports to EsGil
Corporation, 9320 Chesapeake Drive, Suite 208, San Diego, CA 92123, (619)
560-1468. Deliver all remaining sets of plans and calculations/reports directly to
the City of Carlsbad Building Department for routing to their Planning,
Engineering and Fire Departments.
NOTE: Plans that are submitted directly to EsGil Corporation only will not be
reviewed by the City Planning, Engineering and Fire Departments until review by
EsGil Corporation is complete.
• PLANS
1. This project consists of an addition to a commercial building. Plans must be
prepared and stamped and signed by an architect or civil or structural engineer
licensed to practice in the State of California.
2. All sheets of the plans and the first sheet of the calculations are required to be
signed by the California licensed architect or engineer responsible for the plan
preparation. Please include the California license number, seal, date of license
expiration and the date the plans are signed. Business and Professions Code.
3. Provide a Building Code Data Legend on the Title Sheet. Include the following
code information for each building proposed:

provisions of the 1994 UBC. and other current codes.
6. On site plan show all interior property lines, easements, development restricted
areas, or other buildings.
7. Provide a statement on the site plan stating: "All property lines, easements and
buildings, both existing and proposed, are shown on this site plan."
8. Show dimensioned parking layout including any required disabled access
spaces.
• EXITS
9. Note on the plans: "All exits are to be openable from inside without the use of a
key or special knowledge." Section 1004.3.
10. Regardless of occupant load, a floor or landing not more than 1 inch (1/2-inch if
disabled access is required) below the threshold is required on each side of an
exit door. Section 1004.9.
• ROOFS
11. A Class B roof covering is required. Table 15-A. and City of Carlsbad special
requirements.

DEPARTMENT OF STATE ARCHITECT NON RESIDENTIAL
TITLE 24 DISABLED ACCESS REQUIREMENTS
The following disabled access items are taken from the 1995 edition of California
Building Code, Title 24. Per Section 101.17.11, all publicly and privately funded public
accommodations and commercial facilities shall be accessible to persons with
disabilities as follows:
(1) Any building, structure, facility, complex, or improved area, or portions
thereof, which are used by the general public.
(2) Any sanitary facilities which are made available for the public, clients, or
employees in such accommodations or facilities.
(3) Any curb or sidewalk intended for public use that is constructed with
private funds.
(4) All existing accommodations when alterations, structural repairs or
additions are made to such accommodations.
NOTE: All Figures and Tables referenced in this checklist are printed in the California
Building Code, Title 24.
REMODELS. ADDITIONS AND REPAIRS
1. When alterations, structural repairs or modifications or additions are made to an
existing building, that building, or portion of the building affected is required to
comply with all of the requirements for new buildings, per Section 1134B.2.
These requirements apply only to the area of specific alteration, repair or
addition and shall include:
a) A primary entrance to the building and the primary path of travel to the
area in question, and include the following items which serve the area in
question:
i) Sanitary facilities,
ii) Drinking fountains,
iii) Public telephones.
2. If an unreasonable hardship finding is granted, priority should be given to those
elements that will provide the greatest access, per Section 1134B.2.1 Exception
#1. The order of priority shown below should be followed:
a) An accessible entrance.
b) An accessible route of travel.
c) At least one accessible restroom for each sex,
d) Accessible telephones.
e) Accessible drinking fountains.
f) When possible, additional accessible elements such as parking, storage
and alarms.

3. For areas under the control of a single tenant, the obligation to provide access
may not be evaded by performing a series of small alterations to the area served
by a single path of travel, if those alterations could have been performed as a
single undertaking. If an area has been altered without providing an accessible
path of travel to that area, and subsequent alterations of that area, or a different
area along the same path of travel are undertaken within three (3) years of the
original alteration, the total cost of alterations to the areas along that path of
travel during the preceding three year period shall be considered in determining
unreasonable hardship.
SITE PLAN REQUIREMENTS
4. Clearly show that the site development and grading are designed to provide
access to all entrances and exterior ground floor exits, as well as access to
normal paths of travel, per Section 1127B.1. Where necessary to provide
access, shall incorporate pedestrian ramps, curb ramps, stairways and
handrails, etc. Show a conforming path of travel for the H.C. parking to the
building entrance.
• DISABLED ACCESS PARKING SPACES
5. Revise site plan to show that accessible spaces comply with Section 1129B.4.1
asfollows:
a) Single spaces shall be 14'0" wide and outlined to provide a 9'0" parking
area and a 5'0" loading and unloading area on the passenger side of the
vehicle.
b) When more than one space is provided, in lieu of providing a 14'0" space
for each space, two spaces can be provided within a 23'0" area with a
5"0" loading zone between each 9'0" wide space.
c) Each space is to be a minimum of 18'0" in depth.
6. Revise plans to show that at least one in every 8 accessible spaces are served
by an access aisle ^96" in width and designated as VAN ACCESSIBLE, per
Section 1129B.4.2. All such spaces may be grouped on one level of a parking
structure.
7. Show or note that the maximum slope of the parking surface at the accessible
space, in any direction, is <%" per ft (2.083%), per Section 1129B.4.4. The
maximum slope at the passenger loading zone is to be

8. Show or note on the plans that the accessible parking spaces are to be identified
by a reflectorized sign, permanently posted immediately adjacent to and visible
from each space, consisting of:
a) A profile view of a wheelchair with occupant in white on dark blue
background.
b) The sign shall >70 in2 in area.
c) When in the path of travel, they shall be posted ^80" from the bottom of
the sign to parking space finished grade.
d) Signs may also be centered on the wall of the interior end of the parking
space >36" from the parking space finished grade, ground or sidewalk.
e) Spaces complying with Section 1129B.4.2 shall have an additional sign
'Van-Accessible" mounted below the symbol of accessibility per Section
1129B.5.
f) In addition, each accessible space is required to be marked with the
international symbol of accessibility.
9. Show, or note, that an additional sign shall also be posted in a conspicuous
place at each entrance to off street parking facilities, or immediately adjacent to
and visible from each stall or space. The sign shall be >17" x 22" with lettering
not <1" in height. Per Section 1129B.5 required wording is as follows.
"Unauthorized vehicles parked in designated accessible spaces not displaying
distinguishing placards or license plates issued for persons with disabilities may
be towed away at owner's expense. Towed vehicles may be reclaimed at
or by telephoning ."
• DOORS

• SANITARY FACILITIES
12. Where separate nonaccessible facilities are provided for each sex, separate
accessible facilities are required to be provided for each sex as well. Where
nonaccessible unisex facilities are provided, accessible unisex facilities are
required to be provided, per Section 1115B.2.
13. Note that the doorways leading to sanitary facilities shall be identified, per
Section 1115B.5, as follows:
a) An equilateral triangle %" thick with edges 12" long and a vortex pointing
upward at men's rest rooms.
b) A circle %" thick, 12" in diameter at women's rest rooms.
c) A 12" diameter circle with a triangle superimposed on the circle and within
the 12" diameter at unisex rest rooms.
d) The required symbols shall be centered on the door at a height of 60".
e) Braille signage shall also be located on the wall adjacent to the latch

Dear Ms. Housley:
A copy of your plans for expansion of the Barbara McLain Properties Office located at
2715 Carlsbad Boulevard was forwarded to the Housing and Redevelopment Office for
review. Unfortunately, the Carlsbad Village Master Plan and Design Manual does not
allow for the expansion desired for the subject property. Therefore, you will not be able
to obtain approval of the requested building permit. The reasons for denial are explained
in more detail below.
The new Village Master Plan and Design Manual, which became effective on September
12, 1996 for all properties located within the Coastal Zone, does not allow for general
office uses in Land Use District 9 of the Village Redevelopment Area. Your property is
located in Land Use District 9, which is designated primarily as a tourist support area.
This land use finding means that your office is considered a "non-conforming land use".
You will be permitted to continue the office use for as long as you choose to do so.
However, the Redevelopment Agency will not be allowed to approve any expansion of
the existing building.
Enclosed please find copies of the current land use plan for the Village Redevelopment
Area and the regulations related to "non-conforming" land uses. I hope you find this
information to be helpful in any future decisions you may need to make in regard to the
office operations for Barbara McLain Properties.
