Article XIIID of the Constitution of the State of California ("Article XIIID") and the Proposition 218 Omnibus Implementation Act (Government Code Section 53750 and following) (the "Implementation Act") (Article XIIID and the Implementation Act may be referred to collectively as the "Assessment Law") establish certain procedures and requirements which apply when any agency such as the City considers the levy of assessments upon real property. 2. The requirements established by the Assessment Law include the following: a. The proportionate special benefit derived by each parcel to be assessed must be determined in relationship to the entirety of the capital cost of the improvement for which the assessment is to be levied; b. Only special benefits are assessable; and d. The procedures established by the Assessment Law include: a. All assessments must be supported by a detailed engineer's report prepared by a registered professional engineer certified by the State of California. c. Prior to levying a new assessment , the Agency must give written notice by mail (the "Assessment Notice") to the record owner, i.e., the owner of a parcel whose name and address appears on the last equalized secured property tax roll, of each parcel proposed to be assessed. The Assessment Notice must include: (i) the total amount of the proposed assessment chargeable to the entire assessment district, (ii) the amount chargeable to the record owner's parcel, (iii) the duration of the assessment payments, (iv) the reason for the assessment, (v) the basis on which the amount of the proposed assessment was calculated, and (vi) the date, time and location of a public hearing on the proposed assessment. d. The assurance of the City's legal ability to impose the Assessment on the Property is both a material inducement to and a material consideration for the City to enter into this Agreement and agree to issue the Development Permit prior to the construction of the Improvements. B. Owner has had a reasonable opportunity to thoroughly read and review the Assessment Law in its entirety and has further had a reasonable opportunity to consult with Owner's attorney regarding the Assessment Law and the terms and conditions of this Agreement. Section 4.02 Waiver of Rights A. In consideration of the approval by the City of the Development Permit prior to the construction of the Improvements, Owner hereby waives Owner's rights under the Assessment Law to: H:WORD\Masters\FORMS\Neighbortiood Improvement Agmt Rev. 9/06/00 1. object or protest the ordering by the City of the construction of the Improvements and the imposition of the Assessment at such public hearing so long as the amount of the Assessment does not exceed the amount set forth in Exhibit C hereto adjusted for inflation pursuant to Section 3.01B above; 2. submit an assessment ballot in support of or in opposition to the imposition of the Assessment so long as the amount of the Assessment does not exceed the amount set forth in Exhibit C hereto adjusted for inflation pursuant to Section 3.01 B above; and 3. file or bring any protest, complaint or legal action of any nature whatsoever challenging the validity of the proceedings to form the Assessment District and/or the validity of the imposition of the Assessment on the Property. B. In order that the City may be assured of its ability to legally impose the Assessment on the Property and, therefore, be willing to enter into this Agreement and agree to approve the Development Permit prior to the construction of the Improvements, Owner represents and warrants that Owner has knowingly, intelligently and voluntarily waived for and on behalf of Owner, Owner's successors, heirs, assigns and/or transferees, each and every one of the rights specified in Section 4.02A above. C. Nothing in this waiver of rights section is intended to waive the owner's ability to participate in Alternative Streets Design process. Section 5. Alternative Satisfaction of Owner's Obligations Owner's obligations under Section 3 above may be satisfied by paying the amount set forth in Exhibit "C" adjusted for inflation at any time prior to the formation of the assessment in which case a release of this Agreement shall be recorded in the office of the San Diego County Recorder. Section 6. General Provisions. Section 6.01 Conflict with Other Agreements or Requirements of the City. Except as specifically provided in this Agreement, nothing contained herein shall be construed as releasing Owner from any condition of development of the Property or requirement imposed by any other agreement with or requirement of the City. Section 6.02 General Standard of Reasonableness. Any provision of this Agreement which requires the consent, approval, discretion or acceptance of any party hereto or any of their respective employees, officers or agents shall be deemed to require that such consent, approval or acceptance not be unreasonably withheld or delayed, unless such provision expressly incorporates a different standard. Failure by a party to insist upon the strict performance of any of the provisions of this Agreement by any other party, or the failure by a party to exercise its rights under the default of any other party, shall not constitute a waiver of such party's right to insist and demand strict compliance by any other party with the terms of this Agreement thereafter. Section 6.08 Singular and Plural: Gender. As used herein, the singular of any work includes the plural, and terms in the masculine gender shall include the feminine. The captions of the sections and subsections of this Agreement are for convenience only and shall not be considered or referred to in resolving questions of construction. Section 6.11 Recitals: Exhibits. Any recitals set forth above and any attached exhibits are incorporated by reference into this Agreement. Section 6.12 Authority of Signatories. Each signatory and party hereto hereby represents and warrants to the other party that it has legal authority and capacity and direction from its principal to enter into this Agreement, and that all resolutions and/or other actions have been taken so as to enable such party to enter into this Agreement. The subject property is rectangular in configuration and encompasses approximately one- half acre. The site is bounded to the north, west and south by single family residences. Crest Drive abuts the east property line. The property is situated on the top of a north-south trending ridge. The site terrain is generally flat and very gently inclined toward the west. Beyond the property boundaries the topography slopes moderately toward the west and very steeply towards the east, on the opposite side of Crest Drive. Improvements observed on site at the time of our investigation consisted of a one story, single family residence. Vegetation consisted of landscaping around the residence, with trees and wild grasses growing on the western portion of the property. Subsurface Conditions: The subject site is underlain by Quaternary age terrace deposits that have been mapped by Weber (1983) as belonging to the Lindavista Formation. These sediments are mantled by a thin layer of colluvium. Each of these is described below from oldest to youngest. These have been mapped by Weber (1983) as the Lindavista Formation. Work performed by Eisenberg (1983) in the Ericinitas quadrangle classified similar sediments as the Sweitzer Formation. At the location of our exploratory excavations the terrace deposits consist of slightly silty to slightly clayey, fine to medium grained sandstone. These sediments are moderately well indurated, horizontally stratified and massively bedded. Colluvium filled joints occur within the upper 5 to 6 feet of these deposits. The sandstone is poorly to moderately cemented and varies in color from brownish-orange to dark reddish-brown. The terrace deposits were encountered at depths of approximately 2 to 2 l/£ feet and extended beyond the vertical limits of our explorations. Coiluvium: At the location of our exploratory excavations the terrace sediments are mantled by a thin layer of poorly consolidated colluvium. For the purposes of this study the term colluvium is used to describe in-situ developed soil. The colluvium consists of loose, brown, silty, fine grained sand. Within our subsurface explorations it ranged from 2 to 2 l/2 feet in thickness. The colluvium is not considered suitable for the support of structures or new fill in its present condition. However, fluctuations in the level and flow of groundwater may occur depending on annual precipitation and irrigation. Moreover, it has been our experience that periodic events of seepage will occur in areas of significant "cut" or any "below-grade" structures. Therefore, consideration must be given to appropriate surface and subsurface drainage systems such as underdrains and concrete swales. Furthermore, fluctuations in the level and flow of groundwater may occur depending on annual precipitation and irrigation. Geologic Hazards Faults and Seismic Hazards: According to available published information, there are no known active or potentially active faults on or in the immediate vicinity of the project site. Therefore, the potential for ground rupture at this site is considered low. There are, however, several faults located in close proximity that movement associated with them could cause significant ground motion at the site. The table below presents the maximum credible earthquake magnitudes and estimated peak accelerations anticipated at the site. These accelerations are based on the assumption that the maximum credible earthquake occurs on specific faults at the closest point on that particular fault to the site. The maximum credible earthquake is defined as the maximum earthquake that appears to be reasonably capable of occurring under the conditions of the presently known geologic framework. The probability of such an earthquake occurring during the lifetime of this project is considered low. The severity of ground motion is not anticipated to be any greater at this location than in other areas of San Diego County. WESTERN SOIL AND FOUNDATION ENGINEERING, INC. Liquefaction potential decreases with increasing density, grain size, clay content and gravel content. Conversely, liquefaction potential increases as the ground acceleration and duration of seismic shaking increase. Groundwater was not observed in any of the subsurface explorations and the site is underlain by moderately well indurated, well drained sandstones. We anticipate that any poorly consolidated soils encountered during grading will be compacted in accordance with the recommendations of this report. Based on the consistency of the underlying materials and lack of shallow groundwater the potential for generalized liquefaction in the event of a strong to moderate earthquake on nearby faults is considered low. Landslides and Slope Stability: Landslide deposits were not encountered on the subject site. We did not observe any evidence to suggest the presence of deep seated landslides on site or in the site vicinity. Furthermore, adverse geologic structure such as shear zones, fractures or extensive jointing did not occur within our subsurface explorations. The project site is generally flat and it is our understanding that permanent embankments will not be constructed. It is therefore our opinion that the potential for deep seated slope failure is very low. Recommendations and Conclusions Site Preparation: Existing Structures: After demolition of any existing structures or portions thereof and prior to backfilling, all concrete, reinforcing steel, plumbing materials and any other debris or organic matter shall be removed and legally disposed of off-site. Any colluvium or otherwise incompetent soil! material (highly expansive, soft or wet soil material) existing upon the formational soils shall also be removed and replaced as recommended below under the heading "Existing Soil". Howard Residence Addition Our Job No. 98-74 January 6, 1999 Page 8 Existing Soil: At the locations explored, formational materials were encountered at depths ranging from 2 to 2 Vz feet beneath the existing ground surface. At these locations, the formational materials were firm and may be used for foundation support. The colluvial soil encountered at the exploratory trench locations are not uniformly consolidated and are not considered suitable for foundation and floor slab support. To provide more uniform support for the proposed improvements, we recommend that any existing fill, colluvium, low density or otherwise unsuitable material beneath the proposed structures be removed to firm undisturbed natural ground. The new foundations may then be supported on the firm undisturbed terrace deposits or compacted fill soils. The slabs-on-grade may be entirely supported on compacted, non-expansive fill soils. Areas to receive structural fill shall be treated similarly. The horizontal limits of removal and recompaction shall extend at least five feet beyond the exterior of the proposed improvements. Based on the results of our analysis, it appears that the depth of removal will be approximately 2 !/2 feet. Table I (Plate No. 8) of this report presents anticipated removal depths in the area of our subsurface explorations. If groundwater is encountered during the removal and recompaction of the soil, or if difficulty is experienced in achieving the minimum of 90% relative compaction (ASTM D1557-91), then this office shall be consulted for further recommendations. Howard Residence Addition Our Job No. 98-74 January 6, 1999 Page 9 Soil Suitability: The on-site soil materials minus any debris, expansive soils and organic matter may be used as typical fills as described on page 2 of the attached Standard Specifications for Construction of Controlled Fills (Appendix 1). Expansive Soil: Detrimentally expansive soils (Expansion Index of 51 or greater) were not observed within our exploratory excavations. The soils that were exposed consisted of slightly silry to slightly clayey, fine to medium grained sand. If expansive materials are encountered during construction, the Soil Engineer shall be notified so that appropriate recommendations can be made. These recommendations may include, but may not be limited to capping the building envelope with non-expansive granular soil or re-designing slabs and foundations. Imported Fill: Imported fill, if required at this site, shall be approved by our office prior to importing. Imported fill shall consist of non-expansive soil (Expansion Index of 20 or less) and less than 25% passing the No. 200 U.S. standard sieve. Surface Drainage: Surface drainage shall be directed away from structures. The ponding of water or saturation of soils should not be allowed adjacent to any of the foundations. Surface gradients of 1% for hardscaped areas and 2% for landscaped areas should be maintained within 10 feet of any structures. We recommend that planters be provided with drains and low flow irrigation systems. Gutter, roof drains and other drainage devices shall discharge water away from the structure into surface drains and storm sewers. WESTERN SOIL AND FOUNDATION ENGINEERING, INC Howard Residence Addition Our Job No. 98-74 January 6, 1999 Page 10 Surface water must not be allowed to drain in an uncontrolled manner over the top of any excavation. Earthwork: All earthwork and grading contemplated for site preparation must be accomplished in accordance with the attached Specifications for Construction of Controlled Fills (Appendix 1). All special site preparation recommendations presented in the sections above will supersede those in the Standard Specifications for Construction of Controlled Fills. All structural fill and utility trench backfill shall be compacted to no less than 90% of its maximum dry density (ASTMD1559-91). The moisture content of the on-site clayey materials should be maintained 2 to 4% above optimum moisture content during compaction. The moisture content of non-expansive fill should be within 2% of optimum. All deleterious materials and oversized debris (greater than 6 inches in maximum dimension) encountered must be removed and legally disposed of at a licensed disposal site. The maximum dry density and optimum moisture content of each soil type shall be idetermined in accordance with ASTM Test Method D1557-91. Prior to commencement of demolition and clearing of the site, a pregrading meeting shall be held at the site. The owner, surveyor, grading contractor, and soil engineer should attend. Our firm should be given at least three working days notice of the meeting time and date. WESTERN SOIL AND FOUNDATION ENGINEERING, INC. Howard Residence Addition January 6,1999 Our Job No. 98-74 Page 11 Foundation Recommendations New Footings: The proposed structure may be supported on continuous or pad spread footings. To provide more uniform support we recommend that the foundations be entirely supported on either the undisturbed formational material or properly controlled fill soil. Deepened footings may be required in areas of thicker overburden soils. As an alternative to deepened footings at these locations, the footing excavations may be backfilled with a 2 1A sack sand-slurry mix or lean concrete. Howard Residence Addition Our Job No. 98-74 January 6, 1999 Page 12 All continuous footings shall contain adequate reinforcing bars so as to provide structural continuity and to permit spanning of local irregularities. The final foundation dimensions and reinforcing should be determined by the Structural Engineer. The soil load bearing values presented above may be increased by one-third for short term loads, including wind or seismic. The soil load bearing values of any proposed import soil should be determined after its selection. Settlements under building loads are expected to be within tolerable limits for the proposed structures. Existing Footings: Soil conditions beneath the existing footings should be determined during site grading so that the soil engineer may make appropriate recommendations pertaining to the support of existing footings. For design purposes, an allowable dead plus live load soil bearing value of 1,000 psf may be assumed. Surcharge Loads: The proposed foundations for all new structures shall be designed and constructed so as not to surcharge existing structures. This may entail the deepening of new foundations to an elevation below the plane of influence on the existing foundation. This plane of influence is defined as a 1:1 plane (45° from horizontal) extended downward from the edge of the existing foundation. Surcharge loads imposed by existing footings should be considered when estimating the total design load. WESTERN SOIL AND FOUNDATION ENGINEERING, INC. Howard Residence Addition Our Job No. 98-74 January 6, 1999 Page 13 Lateral Resistance: Resistance to lateral loads may be provided by friction at the base of the footings and floor slabs and by the passive resistance of the supporting soils. Allowable values of frictional and passive resistance are presented in the table below. The fractional resistance and the passive resistance of the materials may be combined without reduction in determining the total lateral resistance. Footing excavations shall be cleaned of any loosened soil and debris before placing steel or concrete. Footing excavations should be observed and probed for soft areas. Any soft or disturbed soils shall be overexcavated prior to placement of steel and concrete. For footings extending into the formational materials, the bottom of the excavations should be left uneven or filled with a 2 l/z sack sand-slurry mix, lean or structural concrete. WESTERN SOIL AND FOUNDATION ENGINEERING, INC Howard Residence Addition Our Job No. 98-74 January 6, 1999 Page 14 Concrete Slabs-On-Grade: If the soils are prepared as recommended in this report, concrete slabs-on-grade may be supported entirely on compacted fill. No cut/fill transitions should be allowed to occur beneath the structure. To reduce the potential for cracking and damage due to differential settlement between the slab-on-grade and the foundations embedded in the formational soil, we recommend that the slab be allowed to move independently of the footings. The slab should be separated from the footings and slab dowels should not be used. To provide protection against vapor or water transmission through the building and floor slabs, we recommend that the slabs-on-grade be underlain by a 4-inch layer of clean sand. An impermeable membrane as described below should be placed at the midpoint of the sand layer. In areas where vinyl or other moisture-sensitive floor coverings are planned or where moisture may be detrimental to the structure's contents, we recommend that a 10-mil-thick impermeable plastic membrane be installed to provide additional protection against water vapor transmission through the slab. The vapor barrier should be installed in accordance with the manufacturer's instructions. We recommend that the edges be sealed. Care should be taken during concrete placement to prevent displacement of the sand. A low-slump concrete (4-inch maximum slump) should be used to further minimize possible curling of the slabs. The concrete slabs should be allowed to cure properly before placing vinyl or other moisture-sensitive floor covering. Slab reinforcing and thickness shall be designed in accordance with the anticipated use and loadings on the slab and as recommended by the Structural Engineer. Construction joint spacing and placement shall be provided by the Structural Engineer. WESTERN SOIL AND FOUNDATION ENGINEERING, INC Howard Residence Addition Our Job No. 98-74 January^ 1999 Page 15 Transition Areas: The proposed building should not be allowed to straddle a cut-fill transition line. Foundations and floor slabs should be entirely supported on cut or entirely on fill. The tendency of cut and fill soils to compress differently can frequently result in differential settlement, cracking to portions of the structure and in severe cases structural damage. To reduce the potential for damage due to differential settlement in transition areas, we recommend that cut areas be over excavated to a depth of at least 2 feet below the bottom of the deepest foundation or to a uniform depth for all footings, whichever is less. This soil should be replaced with non- expansive soil material compacted to at least 90% of its maximum dry density (ASTM D1557- 91). The compacted fill should extend at least 5 feet beyond the building floor plan. If all of the footings are to be embedded into dense formational sandstone, then the over excavation should, extend 2 feet below the bottom of the slab subgrade. Field Explorations i Subsurface conditions beneath the proposed development were explored by excavating exploratory trenches on December 1, 1998. The exploratory trenches extended to depths ranging from 6 to 9 feet. No caving of the test pit walls or water seepage were observed during excavation. The locations of the exploratory excavations are depicted on the Site Plan, Plate No. 1, of this report. WESTERN SOIL AND FOUNDATION ENGINEERING, INC. Howard Residence Addition Our Job No. 98-74 January 6, 1999 Page 16 The surface reconnaissance and subsurface exploration were conducted by our geology and soil engineering personnel. The soils are described in accordance with the Unified Soil Classification System as illustrated on the attached simplified chart (Plate Number 2). In addition, a verbal textural description, the wet color, the apparent moisture and the density or consistency are presented. The density of granular material is given as either very loose, loose, medium dense, dense or very dense. The consistency of silts or clays is given as either very soft, soft, medium stiff, stiff, very stiff or hard. The sampling and logging of exploratory trenches were performed using standard geotechnical methods. The logs are presented on Plate Numbers 3 through 5. Samples of representative soils were obtained and returned to our laboratory for observation and testing. Laboratory Testing Laboratory tests were performed in accordance with the American Society for Testing and Materials (A.S.T.M.) test methods or suggested procedures. Test results are shown on Plate Numbers 6 and 7. PHONE: [760] 746-3553 423 HALE AVENUE FAX: (760) 746-4912 ESCONDIDO, CALIFORNIA 92C29 SPECIFICATIONS FOR CONSTRUCTION OF CONTROLLED FILLS General Description: The construction of controlled fills shall consist of adequate geotechnical investigations, and clearing, removal of existing structures and foundations, preparation of land to be filled, excavation of earth and rock from cut area, compaction and control of the fill, and all other work necessary to complete the grading of the filled area to conform with the lines, grades, and slopes as shown on the accepted plans. Clearing And Preparation Of Areas To Be Filled: (a) All fill control projects shall have an investigation or a visual examination. depending upon the nature of the job, performed by a qualified soil engineer prior to grading. (b) All timber, trees, brush, vegetation, and other rubbish shall be removed, piled and burned, or otherwise disposed of to leave the prepared area with a finished appearance free from unsightly debris. (c) Any soft, swampy or otherwise unsuitable areas, shall be corrected by drainage or removal of compressible material, or both, to the depths indicated on the plans or as directed by the soil engineer. (d) The natural ground which is determined to be satisfactory for the support of the filled ground shall then be plowed or scarified to a depth of at least six inches (6") or deeper as specified by the soil engineer, and until the surface is free from ruts, hummocks, or other uneven features which would tend to prevent uniform compaction by the equipment to be used. (e) No fill shall be placed until the prepared native ground has been approved by the soil engineer. Specifications for Construction Paae 2 of Controlled Fills (f) Where fills are made on the hillsides with slopes greater than 5 (horizontal) to 1 (vertical), horizontal benches shall be cut into firm undisturbed natural ground to provide lateral and vertical stability. The initial bench at the toe of the fill shall be a least 10 feet in width on firm undisturbed natural ground at the elevation of the toe stake. The soil engineer shall determine the width and frequency of all succeeding benches which will vary with the soil conditions and the steepness of slope. (g) After the natural ground has been prepared, it shall be brought to the proper moisture content and compacted to not less than 90% of maximum density. A.S.T.M. D1557-91. (h) Expansive soils may require special compaction specifications as directed in the report of geotechnical investigation by the soil engineer. (i) The cut portions of building pads may require excavation and recompaction for density compatibility with the fill as directed by the soil engineer. Materials: The fill soils shall consist of select materials graded so that at least 40 percent of the material passes the No. 4 sieve. The material may be obtained from the excavation, a borrow pit, or by mixing soils from one or more sources., The material used shall be free from vegetable matter, and other deleterious substances, and shall not contain rocks or lumps greater than 6 inches in diameter. If excessive vegetation, rocks, or soils with unacceptable physical characteristics are encountered, these materials shall be disposed of in waste areas designated on the plans or as directed by the soil engineer. If soils are encountered during the grading operation which were not reported in the report of geotechnical investigation, further testing will be required to ascertain their engineering properties. Any special treatment recommended in tie preliminary or subsequent soil reports not covered herein shall become an addendum to these specifications. No material of perishable, spongy, or otherwise unstable nature shall be used in the fills. WESTERN SOIL AND FOUNDATION ENGINEERING, INC. Specifications for Construction Page of Controlled Fills Placing, Spreading And Compacting Fill Material: (a) The selected fill material shall be placed in layers which shall not exceed six inches (6") when compacted. Each layer shall be spread evenly and shall be thoroughly blade-mixed during the spreading to insure uniformity of material and moisture in each layer. (b) When the moisture content of the fill material is below that specified by the soil engineer, water shall be added until the moisture content is near optimum as determined by the soil engineer to assure thorough bonding during the compacting process. (c) When the moisture content of the fill material is above that specified by the soil engineer, the fill material shall be aerated by blading and scarifying; or other satisfactory methods until the moisture content is near optimum as determined fay the soils engineer. (d) After each layer has been placed, mixed and spread evenly, it shall be thoroughly compacted to not less than the specified maximum density in accordance with A.S.T.M. D1557-91. Compaction shall be by means of tamping or sheepsfoot rollers, multiple-wheel pneumatic-tired rollers, or other types of rollers. Rollers shall be of such design that they will be able to compact the fill to the specified density. Rolling of each layer shall be continuous over its entire area and the roller shall make sufficient passes to obtain the desired density. The entire area to be filled shall be compacted ' to the specified density. (e) Fill slopes shall be compacted by means of sheepsfoot rollers or other suitable equipment. Compacting operations shall be continued until the slopes are stable and until there is no appreciable amount of loose soil on the slopes. Compacting of the slopes shall be accomplished by backroiling the slopes in increments of 3 to 5 feet in elevation gain or by other methods producing satisfactory results. Specifications for Construction Page 4 of Controlled Fills (f) Field density tests shall be made by the soil engineer for approximately each foot in elevation gain after compaction, but not to exceed two feet in vertical height between tests. The location of the tests in plan shall be spaced to give the best possible coverage and shall be taken no farther than 100 feet apart. Tests shall be taken on corner and terrace lots for each two feet in elevation again. The soil engineer may take additional tests as considered necessary to check on the uniformity of compaction. Where sheepsfoot rollers are used, the tests shall be taken in the compacted material below the disturbed surface. No additional layers of fill shall be spread until the field density tests indicate that the specified density has been obtained. (g) The fill operation shall be continued in six inch (6") compacted layers, as specified above, until the fill has been brought to the finished slopes and arades as shown on the accepted plans. Supervision: Supervision by the soil engineer shall be made during the filling and compacting operations so that he/she can certify that the fill was made in 'accordance with accepted specifications. The specifications and soil testing of subgrade, subbase, and base materials for roads, or other public property shall be done in accordance with specifications of the governing agency. Seasonal Limits: No fill material shall be placed, spread, or rolled during unfavorable weather conditions. When the work is interrupted by heavy rain, grading shall not be resumed until field tests by the soil engineer indicate that the moisture content and density of the fill are as previously specified. In the event that, in the opinion of the engineer, soils unsatisfactory as foundation material are encountered, they shall not be incorporated in the grading, and disposition will be made at the engineer's discretion.
