Re: Retaining Walls for Miholich Residence, 2375 Cazadero Drive

Dear Mr. Mata:
Per your request, we made a field investigation to determine to
what standards the uninspected walls at 2375 Cazadero Drive were
constructed. The permittee exposed the retaining wall footings
prior to our review. We conducted the field investigation on June
3, 1991. The location of steel in the wall was determined with the
use of a pipe locator.
From our field investigation only 8" block was utilized for all
wall heights up to 54". Steel was placed at 16" on center both
vertically and horizontally. Footing width varies from 26" for the
40" height, 32" for the 48" height and up to 40" for the 54"
height. Footing depth was observed to be a minimum of 12" into
native material at several locations.
In discussions with the workers which built the wall, there was no
continuous key provided in the footing because of the rocky
material. The footing had to be jack hammered wh]ch provided a
very rough trench bottom. Loose material was removed and the
footing was poured to fill these rough voids and in some places
along the higher portions of the wall, rebar was affixed into the
rocks at the bottom of the trench by drilling and using liquid
adhesives.
From our investigation, it would appear that the uninspected walls
were constructed in substantial conformance with the City of
Carlsbad Standard No. BID No. 6. " Concrete Block Walls Level or
Sloping Surcharge." A copy of that document is attached to this
letter. The only variation to the standards would be the
continuous key in the footing. As the bottom of the trench was
formed by angular rock left by the jack hammering, there would be
additional adherence of the footing to the surface of the fractured
rock.

In June, 1989, I went to the City Building Dept. with a
friend by the name of Don Briggs. I had my landscape plans
and I wanted to get a permit to landscape my house in La
Costa. It had basic landscaping and I wanted, "The Best"
landscaped house in La Costa. The clerk at the counter was
Scott Evans. He said I didn't need a permit to landscape.
I told him I heard there was a landscape architectural
committee for La Costa and I was certain I needed approval.
He replied that since it is in La Costa, there is indeed a
committee and supplied me with the phone number to La Costa
Ranch Co. I asked again if he was certain about the permit
and he said the only permit I needed was an anti-syphon
permit for the sprinkler system. He then supplied the
necessary form for the valve. I took my plans to La Costa
Ranch and had them approved.
On February 21, 1990, I picked up a set of pre-printed
requirements for block walls from a "Helen" at the City and
built the walls according to the code.
On February 26, 1990, a City inspector by the name of
Michael Lopez stopped by the house. My wife was just
leaving to drop the kids off at school. Mr. Lopez harassed
her for not having a permit. When my wife called me she was
near tears and very shaken. She asked me to come home and
talk to Mr. Lopez. When I pulled up, I was furious, as you
can well imagine. Mr. Lopez greeted me with, "Hey, do you
work here?" As any other male, I was less than cordial to
this badge heavy woman harasser. He handed me a "stop
notice". I tore it up and shoved it down his shirt. If
Mr. Lopez has a problem, I feel he should have contacted me,
and not harassed my wife.
On February 28, 1990, the City asked me to meet them at
my house, which I did. Several City officials and two
police cars also showed up. Dick Cook did all the talking.
I repeated to everyone present what had happened two days
prior. Then I asked Mr. Lopez if that was all correct.
He confirmed. Then I asked one of the police officers what
he would have done if he were in my shoes. His reply was,
"Probably the same thing you did."

After the City officials left, the two police officers
stayed around for a few more minutes and we talked about
what had happened. The one officer suggested 3 should just
go down to the City and talk to someone. "But not that Dick
Cook. He's so hot you won't get anywhere with him."
I went to the City with an attorney, not as my lawyer,
but just as an observer. He went to the count€>r, asked
Mr. Evans if we needed a permit for this landscape plan that
we had in our hand and again Mr. Evans said no permit was
needed. We then asked to see Walter Brown. Mr. Brown's
reply was, "If one of our inspectors says you need a permit,
then you need a permit."
We went to an engineer by the name of Len Schatsraan.
As fate may have it, Mr. Schatsman used to be employed by
the City as an engineer. When he saw the plan,, his reply
was, "You shouldn't need a permit for this. Let me call
Walter Brown and get this taken care of." Mr. Schatsman
called Mr. Brown. Mr. Brown replied that he didn't want to
go around one of his inspectors and the inspectors request
would have to stand.
I asked Mr. Schatsman to put everything on hold. I
personally called Mr. Brown and asked him to come out and
just look at my place. His reply was, "Bill, C can't and
I won't."
I instructed Mr Schatsman to proceed with the
engineering.
Mr. Mata, my "best" landscaped house in La Costa is now
the worst. It's nothing but dirt and unfinished block walls
and fountains. My kids have been injured on the rebar
sticking out of unfinished foundations. My temporary water
line broke while I was out of town and fortunately, one of
the neighbors summoned the city to turn off the water.
I can't help but think the neighbors are a little upset
because of the appearance of my house. I'd rather not sue
the city, but I must proceed with this landscaping! I feel
the officials are trying to punish me for standing. up to
this cowardly inspector.

NOTICE OF MUNICIPAL CODE VIOLATION
ORDER TO REMOVE
PLEASE TAKE NOTICE: As the owner or occupant of the property
located at 2735 Cazadero Drive; APN: 215-400-10, you are hereby
notified that you are in violation of Carlsbad's Municipal Code,
Section 18.04.010, Uniform Building Code, Section 301 (a),
construction of a glass room addition and three retaining walls
without proper approval or permit .
Please be advised that each day you are in violation of the same
ordinance is a separate offense and you may be charged with an
infraction for each offense. After the fourth offense you could be
charged with a misdemeanor. To comply with the Carlsbad Municipal
Code you must obtain the proper approval and permits for the
construction mentioned above.
You are hereby ordered to be in full compliance with the provisions
of the Carlsbad Municipal Code not later than May 21,1990. This
matter will be referred to the City Attorney's Office for legal
action if you fail to comply by the above-referenced date. You have
been notified in the past regarding this matter, copies of previous

It has come to our attention that three retaining walls and a glass room addition
have been constructed on the above referenced property without proper approval
or permits. Please see the enclosed copies of photographs showing the above
mentioned construction.
The Uniform Building Code, adopted by Carlsbad Municipal Code Section
18.04.010, requires approval and permits for these types of construction.
U.B.C., Section 301 (a) reads as follows
PERMITS REQUIRED. Except as specified in Subsection (b) of this section, no
building or structure regulated by this code shall be erected, constructed,
enlarged, altered, repaired, moved, improved, removed, converted or demolished
unless a separate permit for each building or structure has first been obtained
from the building official.
U.B.C. Section 301 (b) state that retaining wall which are not over four (4)
feet in height measured from the bottom of the footing to the top of the wall
do not require a permit. The retaining walls constructed on the above
referenced property do not meet the exempted criteria. A copy with these
sections of the U.B.C. is enclosed with this letter.
Compliance can be made by obtaining proper approval and permits for the glass
room addition and retaining walls. Twenty-one (21) days from the date of this
letter is a reasonable length of time in which to meet compliance.

ORDER TO REMOVE
PLEASE TAKE NOTICE: As the owner or occupant of the property
located at 2735 Cazadero Drive, APN: 215-400-10, you are hereby
notified that you are in violation of Carlsbad's Municipal Code,
Section 18.04.010, Uniform Building Code Section 301 (a), The
construction of retaining walls without proper approval or permit.
You are hereby ordered to be in full compliance with the provisions
of the Carlsbad Municipal Code not later than April 30, 1990..
This matter will be referred to the City Attorney's Office for
