Carlsbad Village Dr. Scope of inspection entailed visual
inspection of the new service panel and sub-panel for code
compliance and safety, to allow for uninterrupted continuance
of electrical service from SDG&E. Electrical was approved
for electrical service only and noted on inspection card.
Electrical contractor was advised that other electrical
violations remained and would have to be resolved prior
to any final approval from the Building Department.

This is in response to your letter dated 1-21-93. t
went to speak to Jay and he informed me that he has secured
a'location to relocate the "stores" and equipment from 276 •
Carlsbad Village Drive He assured me that the unit will be
totally cI eared on or before February 2, 1993 PI ease
understand that I have no legal way to get him out sooner
In fact, t fervently hope that it does not come to that.
My objective of course, is to comply with your request
to restore the unit and then rent it as soon as he leaves
I hope that the electrician, Mike Lietzell has spoken
to you by now. As per your request, I told him that you
needed to speak to him. ! gave him your number and left you
his on your recorder-it is 726-6985 As you know, I paid
him $882 00 for his work with the understanding that it (the
work) had been signed off by one of your inspectors Mr.
L tetzeI I assured me that your i nspector did approve ALL OF
THE WORK and brought me the inspection record for permit
tt92~1308 This was the large yellow sheet that you came to
my home to verify It was indeed signed off by your
inspector. Also, Mr. LietzelI explained to me that your
inspector was very pleased and approved the entire job
including the meter and a I I extensions from it I fee I I t ke

me i nformed

gets a tenant that takes too much for granted. I assure you

has said to me He did seem quite resigned now that he
understands that he had no right to go to such extremes. I
hope that I don't have a tough time getting him to pay for
all the damage he did. However, that's my concern not yours.

Dear Sir,
On or about December 28, 1992 you were informally advised that the property you own, as
referenced above, was in violation of several sections of the Carlsbad Municipal Code. As you
recall, the dwelling unit at 276 "A" Carlsbad Village Drive has been converted to a retail,
office, and cold storage facility for the restaurant located at 2975 Carlsbad Boulevard. This
conversion includes a number of violations of the Carlsbad Municipal Code, including but not
limited to:
Section 18 04.015
Section 18.12.070
Section 18 12.240
Section 18.08 010
Section 18.19.010
Failure to secure building permits for conversion of the residential
unit to commercial spaces.
Permitting electrical work to be done in a manner which does not
conform to all provisions of the code.
Installation of outside wmng on roof surface.
No permits for mechanical cooling equipment installed at 276 "A"
Carlsbad Village Drive
Maintaining a building deemed to be dangerous per Section 302.13
of the 1979 edition of the Uniform Code for the Abatement of
Dangerous Buildings.
As noted, this list of violations should by no means be construed as a complete list of the
violations which exist on the property.
This communication constitutes a "notice and order" to the owner of record to abate all
violations on the property. The tenants in Unit "B" are at risk due to the conditions which exist
within Unit "A"

To abate the dangerous conditions you must*
1. Desist the use of 276 "A" Carlsbad Village Drive as commercial or storage facility.
2 Remove or repair all electrical work done in violation of city ordinance.
3 Remove all mechanical cooling equipment associated with the commercial use of 276 "A"
Carlsbad Village Drive
4 Reconvert 276 "A" Carlsbad Village Drive to a habitable dwelling unit which meets the
requirements of the Uniform Housing Code.
5 Maintain 276 "B" as a habitable dwelling unit which meets the requirements of the
Uniform Housing Code.
An inspection will be conducted on January 29, 1993 to assess compliance with the order
Should all dangerous conditions not be repaired at that time, vacation of the building may be
ordered until such time as the repairs are completed
