Foote Mike Poote Development company 5205 Kearny Villa Way, Suite 211 San Diego, CA 92123 FLCOI HILLS/TEB BOIMIT, CT 84-35 It has come to our attention that some of the slopes in the above- referenced development are not being maintained in accordance with Condition No. 11 of Resolution No. 2395. A copy of the Resolution No. 2395 is enclosed with this letter. Specifically, the slopes along Avalon Avenue and Stanford Street are brown, not being watered, and in need of being weeded. Condition No. 11 states, "All landscaped areas shall be maintained in a healthy and thriving condition, free from weeds, trash and debris." This is definitely not the condition of the slopes mentioned above. Considering that an agreement was made with the City to avoid having to form either a homeowner's association or a maintenance district, as required by Condition No. 8 of Resolution No. 2395, the responsibility of maintaining these slopes is that of your firm. Generally, if a condition of a Resolution is amended or deleted, the approval for that amendment or deletion is to be made by the City Council at a public hearing. I will be checking with Mike Howes, the planner on this project, to see why this procedure was not followed. Please refer to a copy of a letter from your firm regarding not forming a homeowner's association nor maintenance district. This letter is to inform you that the homes adjacent to the slopes not being maintained, will not receive finals and be released to be occupied until the slopes are brought up to a condition which meets with the City's approval and Condition No. 11. Specifically, the homes on Lots 123, 124, 125, 126, 127 and 128 will not be finaled until the slopes on these lots are brought up to an approved condition. It is requested that this be done as soon as possible so that the process of finalization on these lots not be interrupted for any great length of time. Michael J.
