After speaking with Mr. Swab the owner of the remainder parcel, and confinning his
concerns with Gary Wayne, the Assistant Planning Director, Condition No. 15 of the
Conditions of Approval dated September 27, 1989 for MS 802 shall be changed. The
new condition shall read:
Prior to Parcel map recordation the existing garage door to the two car
garage on the remainder parcel shall be relocated from the south facing
wall to the east facing wall.
The reason for this is that it was determined that the existing garage can be found legally
nonconforming as to its set back requirement since the City was requiring additional
right-of-way along Buena Vista which created the setback nonconformity. Mr. Swab has
indicated he would agree to that change of condition.

Otherwise, we will assume that this is the new standard condition.
