SWIMMING POOL FENCE VARIANCE REQUEST
Your request for a pool fencing variance has been DENIED due to the
following reason:
to meet the requirements of the Carlsbad Municipal Code.

We would think it advisable to either raise the height of the existing
chainlink fence to the rear of the property or erect another fence that
will meet the required five feet height. The gates must be self-closing
and - self-latching.
Please call the BUILDING DEPARTMENT to have the fence and gate requirements verified so that the permit for the pool can be finaled; and
this matter closed.

Dear Sirs,
We are writing to request a variance for the Carlsbad pool fencing
requirements. Enclosed are photos of our back yard, a drawing of our property
showing placement of house, pool, and backyard slope, and a map of the street and neighboring lots. We are requesting the variance both on the grounds of limited access to the pool by neighbors as a result of a natural barrier (a steep slope planted with slippery iceplant), and because our neighbors to the north have view lots and do not wish us to put up a second, higher fence or replace the existing fence.
Much of the yard is enclosed by a 5 foot wooden fence which meets city requirements. As shown on the drawing, this includes the entire left side of the property, the front side, and the right side adjacent to the pool. The problem area is the cyclone fencing along the rear of the property and the along the right side going up the slope, which is about 4 feet high.
Our neighbor who shares the largest part of our rear property line (Lot 348, see map) is adament that we not put up a 5-foot wooden fence next to the existing fence as it would reduce her view. She has carefully put up an open wooden fence to hide the poles and top of the cyclone fence, and has planted a grape vine along the fence for partial privacy. She is also against replacing the existing fence with a higher cyclone fence (which is technically on her property), as it would destroy her carefully landscaping. She is not adverse to us planting a few trees and some shrubs on the slope, so we propose to put in a dense natural hedge of shrubs near the top of the slope which would be 5-6 feet high. The hedge would not be
substantially higher, horizontally, than the 4-fOOt existing fence (see cross section). A similar hedge and/or vines could also be planted on the cyclone fence
on the right side, or the existing fence could be replaced with a 5' wooden one.
There seems to be a precedent in our tract for such variances. According to our Association president, several variances for owners with the same configuration (hill in rear, 4' cyclone fence at top, etc.) have been issued.
