PLAN CHECK 87-173 CALIFORNIA LUTHERAN HOMES, 2855 CARLSBAD BLVD
The project consists of removing a staircase for safety reasons and
with the endorsement of the Fire Department. The staircase no longer
serves a purpose, and some of the senile occupants go down the stairs
and get lost. The total estimated cost of removal and platforming
is $12,000.
Because this area is near a bathroom, the plan checker has indicated
handicap provisions are required. To get to the area it is necessary
to pass fully handicapped bathrooms.
This is a senior citizens home where rooms with baths are provided
for the occupants. All these baths are handicapped equipped.
Nothing would be gained or lost in accessibility. There is none
now and will be none after the construction in the area.
We declare this an unreasonable hardship for the applicant and will
not require the bath in the area of the stairway to be handicap
equipped.

As you cruise through the regulations, you will find exceptions from the
literal requirements of these regulations for existing buildings. Many of
these exceptions may only be incorporated when it is found that an
unreasonable hardship would exist if compliance is provided. Each exception
from the requirements granted because of unreasonable hardship refers you to
this definition. It is the intent that in order to find unreasonable hardship
the enforcing authority must make an evaluation based on the five criteria
incorporated herewith and to document those findings. Unreasonable hardship
is to be determined on a case by case basis.
