In response to your irquiry regarding the above matter the follow-
. ing are the J:asis for revoking the pennit.
1. The original applicant was a Mr. Thanas Stephens, 4015 Isle
Drive, Carlsbad. A fee for plan check was paid by Mr. Stephens,
January 5, 1978, receipt #3391 in the arrount of $90.50.
2. A sewer lateral(only) application was applied for #1350
dated January 27, 1975. The lateral and line oost was paid
for on January 27, 1975. In the arrount of $520.90, receipt
#1350. No se,ier oonnection fees were paid (See application).
3. The applicant applied under the sewer allocation of phase
one and the pennits to build were never taken out, paid for,
or a reason given. For this :reason this depart:nent notified
the owners that the pennit was no longer valid and therefor
was revoked.
4. Under item 10 of the Sewer Allocation the applicant shall
be required to perfonn in the attached manner. (See A to E)

RE: Building Permit/2880 Highland Drive,
Carlsbad, California
Dear Sirs:
Our firm represents the legal interests of Myron and Dorothy
Bremer of 2885 Highland Drive in Carlsbad. Mr. and Mrs. Bremer
also own a lot at 2880 Highland. This land was purchased with the
idea of building a home in which Mr. and Mrs. Bremer hope to
reside in the future. The former owner of that property had
been issued a sewer permit which was revoked because construction
had not been commenced within the time frame required.
It is the desire of Mr. and Mrs. Bremer that they be issued
a building permit to construct a single family residence at-·
2880 Highland Drive with the full and clear understanding that
until the sewer hookup permit is issued to them, that they would
not be issued a certificate of occupancy and that dwelling house
could not be occupied for any purposes, other than the process
of construction.
As you know, prices are rising rapidly, and any ·delay in
construction costs the builder dearly. It is the intention of
Mr. and Mrs. Bremer to build the house personally with perhaps
just some minor exceptions in the area of sub-contracting.
They estimate that the construction time for their home will be
between one and two years on that basis. With that in mind, they
wish to commence that construction as soon as possible. As
indicated, they do it with a full realization that they will
have to have a sewer permit prior to occupancy. It is our under-
standing that such a process would take special Couneil approval
since the present ordinance has been enacted with the understanding
that the construction would be done professionally. I am certain
that it is not the Councils'intent to financially punish the
individual citizens of Carlsbad who are interested in building
their own home.
We would therefore, request of the Counc.il,the authority to have
a building permit for construction purposes only. We will, at the
January 29, 1979

same time, make application for sewer capacity for issuance at the
time that that capacity becomes available.
We thank you for your attention to th.is matter, and would
request that if this item needs a variance or would be placed
on the Agenda of the City Counail for public hearing, that we
would be notified so that we might be present and present testimony
on the Bremers' behalf.
