city or county which requires a permit to con-
struct, alter, improve, demolish, or repair any
structure, prior to its issuance also requires the
applicant for such permit to file a signed state-
ment that he is licensed pursuant to the provi-
sions of the Contractor's License Law (Chapter 9
commencing with Section 7000 of Division 3 of
the Business and Professions Code) or that is ex-
empt therefrom and the basis for the alleged ex-
emption. Any violation of Section 7031.5 by an ap-
plicant for a permit subjects the applicant to a
civil penalty of not more than five hundred dollars
($500).

PROCEDURES
Application to Planning Commission: In an effort to aid the
applicant, the Planning Department requests that it be given
an opportunity to evaluate and discuss the application in its
various stages of development prior to submittal . It is more
effective if applicant meets directly with. staff; however,
written or telephone communication is acceptable. It is --the
responsibility of the applicant to make the initial contact
for such meeting.
Submittal: Application will be accepted only if the applica-
tion, plans and other pertinent materials are complete.
Generally, the date application will be heard will be deter-
mtned by the submittal date as indicated within the approved
lanntng Commission calendar.
Planning Commission Calendar: The Planning Commission adopts
an annual calendar that indicates application closing dates,
staff review dates, staff report completion dates, and Plan-
ning Commission hearing dates. You may acquire this calendar
at the Planning Department.
Staff Review: On the date as indicated on the Planning Commission
Calendar, City Staff conducts a review meeting on all items on
the Planning Commission agenda. The applicant is invited to
attend and to explain the project and respond to staff preliminary
recommendations. Upon completion of this review, Staff will pre-
pare final staff recommendations to be submitted to the Planning
Commission. The final report with recommendations will be
available at the Planning Department five days prior to the
Planning Commission hearing (Friday afternoon prior to the
Planning Commission meeting date).
Hearing: The Planning Commission meets every 2nd and 4th
Wednesday of the month at 7:30 p.m. or as indicated on the
Planning Commission calendar. Depending on the type of appli-
cation, the Planning Commission will, either make a finding
and forward to City Council or make final action.
Appeals: Final action by Planning Commission may be appealed
to the City Council, provided such appeal is filed within ten
(10) days after the Planning Commission action. The applicant
should review with staff the procedure on the various types of

Subject: Preliminary Soils Report
Site: Northeast Corner Laguna St. and Pio Pico, Carlsbad, Ca.
To whom it may concern:
Our firm has completed an investigation of the natural soil at
the above site. The native soil is a red brown silty sand
(SM per the Unified Soil Classification) and is not detrimentally
expansive.
On February 15, 1979 we explored the subsurface soils to a depth
of 8'. Two test holes were drilled showing only slight differences
in the soil texture from the ground surface to the full depth.
A sample of soil was taken at the 4' level for determination of
allowable bearing pressure. At the time of sampling the soil was
in a moist, loose condition.
The soil sample was tested for maximum density, optimum moisture
and direct shear. The results of these tests are as follows:

Due to the soil density the foundation areas will require excavation
and recompaction. The limits of the recompaction should be to at
least 4' below finished grade and 10' clear of all buildings. Parking
lot areas should be compacted to not less than 2' below subgrade.
Grading and compaction should be accomplished in accordance with the
attached specifications.
Alloable bearing pressure for single story 12" wide x 12" deep foot-
ings is 3000#/sf. Two story construction may use 3750#/sf if footing
dimensions are at least 15' wide and 18" below lowest adjacent finish
grade. Round and square pier footings may use bearing pressures as
follows:

STANDARD SPECIFICATIONS FOR PLACEMENT
OF COMPACTED FILLED GROUND
Objective:
Obtain filled ground which is uniform and has adequate internal
strength to support any structures proposed. The method by which
this is obtained is described herein.
Preliminary Proceedures.:
Permits - Owner shall ascertain the grading permit require-
ments of the agency whose jurisdiction Covers the land on which the
grading is to be performed and shall be responsible •f or complying
with them,
Water - An adequate water supply shall be provided so that
compaction -of filled ground will not be delayed.
Soils Engineer -.A soils engineer shall be retained to pro-
vide direction in grading, testing for compaction and certification
that the grading complies with grading ordinances .and with approved
grading plans.
Grading:
Clearing and Grubbing - All natural surface which is to be
covered by filled ground, .excavated or needed for brow ditches,
swales or other grading appurtenances shall be cleared and grubbed..
Trees, shrubs and grass, as well as organic overburden shall be
removed from the area to be graded. Cleared material may be disposed
of as approved hythe local controlling agency. No embankment shall
consist of trees, shrubs or other-organic material.
Natural Ground Preparation - Natural ground shall be excavated
from beneath embankment areas to solid material, the exact depth as
determined by the soils engineer. This material shall be brought
to proper moisture content and recompac ted to .not less • than 90%
maximum density as determined by A.S.T.M. D-1557-70.

Any existing fill which has not been certified must be removed and
recompacted.
If the slope of the existing ground exceeds 1' vertical in 6
horizontal, a bench cut level, 10' wide shall be excavated at the
toe of the fill. This will allow the embankment to be placed on
a horizontal base for more uniform compaction.
Embankment Placement - Fill material should consist of native
or imported material whiöh has been brought to the optimum moisture
content. Paterial to be used for embankments may have rocks with
diameters greater than .12" providing they are evenly distributed in
the soil mixture and are at least 3' below finish grade. Fill slopes
shall not consist of, nor be founded on, large rocks. Although
rocks may be placed along the outside of the toe of the fill slopes.
Eock placement in embankments shall be under direct supervision of
the soils engineer.
Embankment material shall be placed in layers varying from 6" to
12" deep depending on soil type,and compacted by suitable compact-
lye effort to a density, of not less than .90 of the maximum density
as determined by A.S..T.M. D-1557-70. Woisture content and depth
of.. layers shall be determined by the soil engineer at the time of
grading, and shall be updated whenever embankment soil types change.
As the embankment increases in elevation new benches shall be cut
into original ground. Benches shall be at least 6' horizontally
into natural ground, be level and shall occur at intervals -to be
determined by the soils engineer at the time of grading.
Compaction may be obtained by the use of any combination of equip-
ment which will result in an embankment that is properly compacted,
uniform in moisture and properly finished to the lines and grades
shown on the plans or to those set forth in the applicable grading
ordinance.

Cut slopes shall be protected from erosion by brow ditches. Brow
ditches shall be either earthen or lined with erosion resistant
material as shown on the plans or as recommended by the engineer.
Embankinen-ts shall be protected from erosion by placing an earthen
berm along the top of slope for the entire perimeter of the fill.
Where drainage is brought down the slope, the drainage way shall
be lined with erosion resistant material to prevent loss of embank-
ment slopes.
Where eaves are located less than 5' horizontally from top of fill
:siopes, 'eaves troughs shall be provided to prevent weakening of
slope due to water intrusion..
All areas of the building pad must be well drained. Drainage swales
shall have a mimimum slope of 1' vertical in 10.0' horizontal unpaved
or 1' vertical in 200' horizontal paved with concrete. Drainage
shall be provided to ensure foundations will not be subjected to
ponded water.

The Carlsbad City Council has approved an ordinance that will impose
a license tax on new construction. The purpose of the tax is to
raise revenue to pay for public facilities such as parks, major streets,
traffic signals, storm drains, bridges and public buildings. The
necessity for such facilities results directly from new construction
and the most practical and equitable way of paying for such'facilities
is a tax on new construction. The ordinance will not becorneeffective
until it is approved by the voters of Carlsbad at a special election
to be held June 5, 1979. However, the tax imposed by the ordinance
will apply to building permits issued on or after April 1, 1979. The
tax will not be collected until the voter approval is obtained. The
purpose of this letter is to inform you that, even, though you have
obtained a building permit which is subject to the tax, you will not be
required to pay the tax until after the election. No occupancy permit
shall be issued or occupancy permitted until the tax due has been paid.
The tax will be 3% of the valuation of the building permit for each
residential dwelling unit and for all commercial and industrial con-
struction. Building permits issued for remodeling 'or alterations to an
existing residential dwelling unit are not subject to the tax unless
an additional dwelling unit is created. A credit toward the tax will
be given for park land or fees which may have been given previously.
There are also certain exceptions and exemptions from payment of the tax.
The amount of credit for previous dedications, exemptions, or exceptions
will have to be determined in each case.
The tax will be payable at the time a building permit is issued, except
for those permits issued between April 1, 1979 and the certification of
the election, in which case the tax will be payable prior to the
issuance of an occupancy permit.
