Dickerson, Jr. 1241 State Street San Diego, California 92101 ,-- ;/^' Fisherman Supply Sewer Line—-^ Pursuant to our telephone conversation on January 16, 1986, I discussed with the city engineer the possibility of locating a sewer line in a private easement along the easterly boundary of the Fisherman Supply building. The city engineer indicated that he had no problem with placing the line in such an easement. He indicated, however, that the utilities and maintenance director would require a cleanout to be placed where the private easement intersects with the existing public utility easement and the sidewalk. This cleanout must be located to the satisfaction of the utilities and maintenance director to allow the city access to the lateral from the point where the private easement terminates to the sewer main located in Grand Avenue. Maintenance and repair of the sewer lateral located in the private easement would be the responsibility of Fisherman Supply and not the city. As mentioned in the city engineer's April 25, 1985 Notice to Connect the Public Sewer, the line in the private easement should connect with the existing sewer lateral which runs from the main in Grand Avenue to your property. Further, as also mentioned in that notice, utilization of the line and easement connecting with the sewer main in Washington Avenue will not be permitted. It is the obligation of Fisherman Supply to determine the method of compliance with the city engineer's Notice to Connect and the compliance must be in accordance with the policies of the city engineer and the utilities and maintenance director. If placement of the line to connect with the sewer main in Grand Avenue is to he made under the driveway on the east side of the Fisherman Supply property, I suggest that you immediately submit plans for that line to the city engineer for his approval. Your client is now six months beyond the compliance deadline established by the city engineer. We suggest advising your client to commence compliance actions immediately. LTD On Tuesday 12-11-84 at 8:00 a.m. we contracted Jobe Gay to remove a 4" slab of concrete to expose the sewer run on the north side of the Twin Inns property. Present at that time were Robert Burke, General Partner of T.I.L. Ltd., Gordon Columbo of Harshbarger Construction Corporation, and Tony Mata of the City of Carlsbad. Extreme care was taken to see that the sewer pipe was undisturbed during this operation and this was verified by all present. On 12-12-84 at 3:03 p.m. the following city employees were present at the site: Denny Johnson, Pat Kelly, Louie Montanex, and Larry Willey. The sewer line was exposed by hand shovel and the accumulated sewage was removed. The following conditions were found upon performing a dye test: 1. Dye test revealed that both buildings are hooked-up to a common 4" clay line. 2. The 4" clay line is broken and emitting raw sewage. 3. Upon washing down of the clay pipe at the broken area, it was revealed that the line is plugged up with solid mass and possibly defecting and failing further on down the 200-foot line. This office directs you to correct or replace this defected line to assure proper, function and avoid any future unsani- tary and hazardous conditions. Your immediate attention to this matter will be greatly aPPreciated, Failure to comply could result in future legal action from the City Attorney's Office. On September 21, 1984 I investigated and found a small amount of liquid seeping from the old concrete foundation behind the work shed. The toilet in the Fisherman's Supply building was dyed and no dye appeared on the ground. The toilet at the chiropractic office at 2924 Carlsbad Boulevard was also dyed and rechecked on September 25. No evidence of dye on the ground was observed. On November 1, 1984 I dyed the toilets in the Twin Inns Restaurant. On the November 2 recheck no evidence of dye was found. The Fisherman's Supply toilet was dyed again and a follow-up on November 5 revealed no dye on the ground. Since no sewage effluent has been observed surfacing on the ground, no action can be taken by this department. Senior Building Inspector TM:hmj OCTOBER 23, 1984 TO: MARTY FROM: ' Tony Mata 2906 GRAND - FISHERMAN'S WHARF Met with Bob Burke at Twin Inns. He showed us (myself and Louie Montanez) the problem area. I recommend we inform the people at the Fisher- man's Wharf to make arrangements to connect to main City sewer system. The Health Officer will also be informed of problem. He evidently did not see any problem because the dye did not show-up at the problem area. Louie says his eight-tablet dye test also did not show up but in some case it never shows. Louie says there is a definite problem, TM:hmj
