RELEASE OF AFFORDABLE HOUSING MITIGATION AGREEMENT
NOTICE IS HEREBY GIVEN that the Affordable Housing Mitigation Agreement
between the City of Carlsbad (“City”) and Kaiza Poinsettia Corporation, a California
corporation (“Kaiza”), as extended to September 30, 1997 (“the Affordable Housing
Mitigation Agreement”) required by an application for MP- 175(D), GPA9 l-05, LCPA9 l-
02, and LFMP 87-09(A) - Poinsettia Shores Master Plan recorded on September 2 1, 1995
as Document No. 1995-0422825 (“Poinsettia Shores Master Plan”) is hereby released for
the following reason(s):
In accordance with Section 1 of the Affordable Housing Mitigation Agreement
and that certain Agreement Regarding Participation Payment, between
Metropolitan Area Advisory Committee on Anti-Poverty of San Diego County,
Inc. (“MAAC”), and Kaiza, dated September 13, 1995, as amended by that certain
First Amendment to Agreement Regarding Participation Payment, dated May 15,
1996, as amended by that Second Amendment to Agreement Regarding
Participation Payment, dated March 19, 1997, as amended by that certain Third
Amendment to Agreement Regarding Participation Payment, dated August 27,
1997, Kaiza has fully satisfied and fulfilled all obligations and conditions imposed
by City relative to Inclusionary Housing in the Poinsettia Shores Master Plan and
Kaiza has fulfilled all obligations and conditions under the Affordable Housing
Mitigation Agreement, including, without limitation, the Inclusionary Housing
Requirements, through the payment by Kaiza to MAAC of Two Million Two
Hundred Eighty-Four Thousand Nine Hundred Twenty Dollars ($2,284,920.00).
