CERTIFICATE OF NONCOMPLIANCE 2042511900 140 Hemlock Ave, A, B, C & D , Carlsbad, CA 92008-8232 MAJOR HARBOUR September 05, 2019 Pursuant to Section 18.04 of the Carlsbad Municipal Code, the City of Carlsbad hereby gives notice, as public record, that the above identified real property within the City of Carlsbad, and more specifically described as: 140 Hemlock Ave, A, Carlsbad, CA 92008-8232 is not in compliance with the provisions of the Carlsbad Municipal Code and contains the following violations: CMC 3.12.050 -Transient Occupancy Tax -Operators Duties CMC 5.60.050 -Short-term vacation rentals permit required. The property owner failed to collect and remit the transient occupancy tax as required by the City of Carlsbad Municipal Code short term vacation rental stays from 09,01/2016 through current day. Because there was a failure to remit the tax imposed within the time required, a penalty of ten (10) percent of the amount of the tax was due in addition to the amount of the transient occupancy tax. There will also be a second delinquency penalty of ten (10) percent of the amount of the tax and the ten (10) percent penalty first imposed. In addition to the penalties imposed, the operator failed to remit any tax imposed and shall therefore pay interest at the rate of 1.5 percent per month or fraction thereof on the amount of the tax, exclusive of penalties, from the date on which the remittance first became delinquent, until paid. The property located at 140 Hemlock Ave Units A, B, C & D, CARLSBAD, CA 92011 is located inside the Coastal Zone and is advertising and operating as a short-term vacation rental without permit or business license. The owner has been notified thereof, and this notice shall remain on record until all necessary corrections have been made and the property is in compliance with the Code sections related to the violations cited. Until a Certificate of Compliance is record ed by the Building Official of the City of Carlsbad, all applications for grading permits, use permits, major and minor subdivisions, rezones, specific plans, specific plan amendments, general plan amendments, discretionary approvals and building permits may be denied
