divided or has resulted from a division or combining of lots in compliance with
the Subdivision Map Act and with the provisions of the Carlsbad Municipal Code
pursuant thereto.

in the City of Carlsbad, County of San Diego, State of California
as shown on Map No. 5162 recorded in the Office of the County
Recorder of San Diego County on April 23, 1963, more particularly
described as follows:
Beginning at a point that is the intersection of the Southeasterly
line of Cove Drive as shown on the Map of said Shelter Cove with
the Southwesterly line of said Lot 40; thence along the South-
easterly line of Cove Drive North 43°51'33" East, 50.00 feet;
thence at right angles South 46°08'27" East, 100.00 feet to the
Southeasterly line of said Lot 41; thence along the last said
