HOLLY is the owner and subdivider of that certain real property located in the City of Carlsbad, Count+,,of .’ San Diego, State of California, described as follows: Lots 1 through 10, inclusive, of Holly-Brae Estates, according to map thereof number 551 filed in the office of the County Recorder of San If California, on FEs 1 iego County, ? o%cr hereinafter referred to as LAND. 2. The Planning Commission of CITY by Resolution No. 1055 approved the tenative subdivision map filed by HCLLY, subject to the condition that, among other things, HOLLY, 0 . . . cause to be executed and recorded in the Office of the San Diego County Recorder an agreement and covenant running with the land that all inhabited lots within the subdivision shall. be connected with sanitary sewers when such sewer becomes available along El Camino Real,,regardless of whether said lots then have other disposal facilities, and that all lots which are improved subsequent to the availability of sewers along El Camino Real shall be connectlsd to it.” 3. HOLLY now wishes to have approval of its final subdivision map. COVENANTS : It is mutually agreed between the parties hereto as follows: 1. CITY ggrees that HOLLY has, by the execution and recordation /I ,,--_--_-.. ,- -10 1 hereof, fulfilled his obligation under the above stated i condition to the approval of its tenative subdivision map. 3 2. HOLLY, on behalf of itself, its heirs, successors, and 4 assigns in ownership of LAND or any portion thereof, agrees 5 as follows: 6 a. All inhabited lots on LAND shall be connected to sani- 7 tary sewer when such sewer becomes available along 8 El Camino Real in the area Easterly of LAND, regardless 9 of whether said lots then have other disposal facilities, 10 and further that all lots on LAND which are improved 11 subsequent to the availability of sewer along 12 El Camino Real shall be connected to it. 13 b, This agreement shall create a covenant running with the 14 land and shall bind all future lot owners. The respons- 15 ibility of each future lot owner hereunder shall extend 16 only to the property owned by him. 17 C.
