entitled action on August 4, 2004. adjudicating that Plaintiff is entitled to take by condemnation the
property described hereinbelow and in accordance with said Judgment, Plaintiff has paid the sum
of money due;
NOW, THEREFORE, IT IS HEREBY ORDERED, ADJUDGED, AND DECREED that
the real property and real property interests situated in the County of San Diego. State of California,
and more particularly described in Exhibit A attached hereto and made a part hereof, be condemned
to Plaintiff for the purpose of the Cannon Road Extension Project.
IT IS FURTHER ORDERED, ADJUDGED, AND DECREED that a certified copy of this
Order be recorded in the Office of the County Recorder of the County of San Diego, State of
California, and thereupon, the interests in said property as described in Exhibit A shall vest in
Plaintiff.

Judgment as hereinafter set forth may be entered; and that CITY represents that it has no present
2 plans to expand Cannon Road adjacent to the PARKWAY NURSERY location; and it further

appearing to be a proper case therefor;

5 IT IS ORDERED, ADJUDGED AND DECREED:
6 1. That Plaintiff take, acquire and condemn the rights, title and interest in the interests
in real property described and depicted in the Final Order of Condemnation, the form of which is
attached hereto as Exhibit A;

2. That the condemnation and taking thereof are for the public purposes set forth in the
,j Complaint on file herein, and are necessary for such public use;
12 3. That the payment to Defendant PARKWAY NURSERY, of the sum of $430,960.25
§ for the taking of the interests in real property as described and depicted in the Final Order of
14 Condemnation shall constitute full and final payment for the condemnation and taking of said real

property and interests in real property, and extinguishes all defendants' claims except as set forth16

herein which could have been made in this action, including, but not limited to compensation for
property taken, interest, relocation benefits, costs, loss of goodwill, attorneys' fees, litigation
" expenses, precondemnation damages, claims for inverse condemnation, and all other damages and
20 claims relating to this action;

4. That said payment as hereinabove specified shall terminate, cancel, and extinguish22

all liens, leaseholds and encumbrances of whatsoever nature the property taken except that
PARKWAY NURSERY maintains, owns and hold rights of an abutter along Cannon Road.
25 Inclusive of PARKWAY NURSERY'S abutters' right, is PARKWAY'S access through the "T"
26 intersection with new Cannon Road construction by the CITY and PARKWAY NURSERY' s access

promptly apply to this Court for issuance of the Final Order of Condemnation in the form attached
hereto as Exhibit A, and upon issuance of said Final Order, Plaintiff shall take, acquire, condemn,
and own the interests in said real property, referred to and described therein;
23 4. That possession having been taken by Plaintiff on February 1,2003, as to the property

described in the Final Order of Condemnation, all taxes, penalties, costs, liens, leaseholds, and
encumbrances of whatsoever nature which are a lien on said property, and which are apportioned to
that portion of the fiscal year after said date are hereby canceled pursuant to Section 5081, et seq.
