The Permitor hereby grants permission to the City of Carlsbad and its designees, agents, employees, contractors, and authorized
representatives to enter upon the hereinafter described real property for the purpose of removing the existing side and rear yard
hardscape and landscape improvements and replacing same with like kind improvements in conformance with the improvement
plans indentified as HP-4 and R-3 which are attached hereto and made a part hereof.
The real property referred to hereinabove and made subject to said Right Of Entry Permit by this grant is situated in the City of
Carlsbad, County of San Diego, State of California, and is more particularly described as follows:
LOT i ot CARLSBAD TRACT NO. 83-29; HARBOR POINTE, UNIT 2, IN THE-CITY OF CARLSBAD, COUNTY OF SAN
DIEGO, STATE OF CALIFORNIA, ACCORDING TO MAP THEREOF NO. 11335 FILED IN THE OFFICE OF THE
COUNTY RECORDER OF SAN DIEGO COUNTY ON SEPTEMBER 20, 1985, AS FILE NUMBER 85-349209 OF OFFICIAL
RECORDS.
This Right of Entry Permit is granted with the acknowledgment that the permitor has agreed to accept the like kind replacement of
the existing hardscape/landscape improvements in lieu of a cash payment based upon the depreciated value of said improvements.
It is understood and agreed that the Permitor shall not be held liable for any damage to equipment or injury to personnel of said
Permitee, its agent(s), contractor(s), or employees resulting from the Permitee's use of said real property.
It is agreed and confirmed by the parties hereto that notwithstanding other provisions in this Right Of Entry Permit, the right of
possession and use of the subject property by the City of Carlsbad, including the right to remove and dispose of said improve-
ments, shall commence on February 1, 1994, and that the like kind replacement of said improvements includes, but is not limited
to, full payment for such possession and use, including damages, if any, from said date. It is further understood that all work wi]l
be comploled4H eonformancc with said improvement plans aad be subject to Pcrmitor'sacceptance.
This Right of Entry Permit shall remain in force for twenty-four (24) months from said date of possession and be binding upon
the permitor's heirs, assigns, and successors. The Permitor hereby authorizes this Right of Entry Permit to be recorded with the
County Recorder of the County of San Diego, California.
