AGREEMENT
AGREEMENT made between the City of Carlsbad, a Municipal
Corporation of the State of California, sometimes hereinafter
referred to as the "CITY" and Vivian S. Carter, sometimes herein-
after referred to as "OWNER".
RECITALS: TVHEREAS, Vivian S. Carter owns real property in
the City of Carlsbad, County of San Diego, State of California,
and described as follows:
That portion of Lots 19 and 20 of WILSONIA TRACT in
the City of Carlsbad, County of San Diego, State of
California, according to Map thereof No. 2169, filed
in the Office of the County Recorder of said County
August 13, 1929, more fully described as follows:
Beginning at the most Northerly corner of said Lot
19, thence South 35°07'30" East 101.17' to the TRUE
POINT OF BEGINNING of the hereinafter described parcel;
thence continuing South 35°07'30" East 116.44"? thence
South 55°27' west 168.71'? thence North 34°33' West
116.44'? thence North 55°27' East 169.81' to the
TRUE POINT OF BEGINNING.
The hereinbefore described parcel being also shown as
Parcel "C" of Lot Split 55-57 as shown on said Lot
Split Plat on file in the Office of Carlsbad City
Engineer. For convenience sake, a copy of Lot Split
Plat 55-57 is attached hereto and made a part hereof
as Attachment "A".
WHEREAS, there is no sewer line in Crest Drive at this

time.

WHEREAS, OWNER also owns a lot fronting on Wilson Street,
which said street contains a public sewer.
WHEREAS, OWNER wishes to connect to the sewer in Wilson
street to preclude problems with her on-site disposal system.
NOW, THEREFORE, WITNESSETH:
It is mutually agreed between the parties hereto as follows:
1) CITY agrees to allow OWNER to connect her existing
home, by way of an easement, to the sewer line ex-
isting in Wilson Street in the City of Carlsbad.
2) OWNER agrees as follows:
a) To grant to the benefit of Parcel "C", Lot
Split No. 55-57 an easement for sewer purposes
across Parcel "D", Lot Split No. 55-57, as
shown on the Lot Split Plat on file in the
Office of the City Engineer of the City of
CarlslDad.
b) To participate in any future assessment district or
improvement proceedings instituted or proposed
to install a sanitary sewer main on Crest Drive
in front of said property.
The benefits and obligations of this Agreement shall be
appurtenant to the property first above described and shall be
binding upon the successors, heirs and assigns of Vivian Carter.
