CONFOW4AMCE WITH THE CALIFORNIA COASTAL ACT OF 1976 :
The proposed dsvelopment is in conformity with the provisions of Chapter 3
the California Coastal Act cf 1976, and would not prejudice the ability of
affected local government to Frepare a Local Coastal Program that is in cc
formity with Chapter 3 of the California Coastal Act of 197G. There are n
feasible alternatives, or feasible mitiqation measures, as provided in the
California Environmental Quality Act, availcble which would substantially
. lessen any significant adverse impact that the developmnt may have on the

CONSIDEilATIONS:
Tierra Del Oro is a 21-lot single-family residenti?.l:s+division on i
street betxeen Carlsbad Blvd. and the sea bluffs. Thirteen of the lots 2;;
rontage, ar.d all of these have single-family residences except for the tb
mediately to the south of the s-hject site. Ccnstruction of a single-f;
dcncc on the lot to the south adjacent to +.he suhjcct site was recent:
he Commission (F'3505). The subject site is south of undeveloped SDG&I
lands and Carlsbad State Beach.

tha existing single-family xcsidenck, and new construction.of 1,334 sq.ft. of
nzw living space. Parking consists of the existing 2-car garage. The nex
adaition includes a second stoq.
The prGject proposal oriyinaliy included a 6-foot hiqh chain link fence to be
co:lstrilcted on the face of the bluff. The Commission finds that. special cc:ldF:
tions 3 and 4, which prohibit the erection of the fence or any other structures
seaward of the walkwar near the residence will help ensure that the visual quality
of this coastal bluff is maintained. An existing stairway, which consisks of
wooden steps a::d does not hcve any handyails, is located along the southern bour.4-
ary of the subject lot along a portion of the face of the bluff. This stairvay
is relatively inconspicuous, and can re,w.in in its present form on the b3.uff
bc prohibited.

hazards from stormwaters, Ssecial condition #1 ensures that the applicants are
aware of potential dangers and that they relieve the Commission of any iiabilities.
This proposed project i.s located between the sea and the nearest public road.
In acccl-dan'ce with Coastal Act Section 30604ic) , the Commission finds that the
project, as conditioned, conforms with all public access and recreation policies
of Chapter .3 of the Coastal Act. Cor:dition ,#3, which requires the applicant tc
dedicate that portion of the lot sezward of the Sluff, will ensure that adequate
lateral public acce5s will exist.
Vertical access to the beach fron Carlsbad Blvd., is situated approximately 100
feet to the north. Thus, agproval of the project is not expected to impact public
access to the beach.
The proposed structure is sot back within the "stringline" between existing de-
velopment on either side.
The proposed single-fanily residence will be conpatible in scale and charactqr
with surrourAing development. with the attached conditions, no adverse inlpacts
to coastal resources are expected to result from approval of the project.
, SPECIAL CONDITIONS :
1. Prior to the transmittal of a coastal development permit, the applicants
shall 6dmi.t to the Executive Director a recorded d.eed restriction that
hinds the applicants and any successors in interest'. The deed restric-.
tions shall provide: (a) that the applicants understand that the site
may he subject to extraordinary hazard from erosion and ZanJslides . -
