First American Title Insurance Company has informed me that the
legal description placed on the Grant Deed for the property at 801
Pine Avenue requires amending to be identical to the legal
description as set forth in the preliminary title report.
To execute this amendment, attached is a set of Supplemental Escrow
Instructions. Please have the Mayor sign the instructions on behalf of both the City and the Housing and Redevelopment Commission. Please also have the Mayor initial the attached amended legal description. Both documents should be returned to my office. If you have any questions regarding this matter, please
call me at extension 4380.

My previous instructions in the above numbered escrow are hereby amended and/or supplemented in the following particulars only:
1. The legal description as set forth as Exhibit "A" of in original escrow
instructions dated October 18, 1988, has been amended to be the legal description
as set forth in preliminary title report, order no. 977134-10 issued by First
American Title Insurance Company dated July 26, 1989 as is attached hereto as
Exhibit "A" and made a part hereof.
2. The Buyer, by signature on this instruction, hereby approves the following items in the above referenced preliminary title report to show in the policy of
title insurance to be issued at the close of this escrow: 1 through 11.
3. Parties acknowledge that outside of escrow, a Grant Deed was recorded from
the Carlsbad Unified School District to the Carlsbad Housing and Redevelopment
Commission on June 20, 1989 as instrument no. 89-324604. Prior to the close of
this escrow, parties shall deliver to Escrow holder with these signed
instructions, the original recorded Grant Deed with legal description corrected
to read as per Exhibit "A". Said Deed shall also have a current notary
acknowledgement of Seller's signature. The deed shall state the following "This
Grant Deed is being re-recorded to correct the legal description."
4. Parties acknowledge that there shall be no consideration for subject property paid to the Seller through this escrow.
5. Parties herqto acknowledge that all conditions precedent to the close of
this escrow have been satisfied and/or waived and Escrow holder is authorized and
isntructed to close this escrow.
