The real property referred to hereinabove and made subject to said temporary construction easement is situated in the City of Encinitas, County of San Diego, State of California, and is more particularly described in the attached Exhibit "A" and 2s show11 o~i the. aitaciled Exxi;Yuit "E". The Grantee agrees that it shall be responsible for the restoration of the area lying within the temporary construction easement to the condition existing prior to entry, as nearly as possible. If any existing landscaping and related irrigation system is damaged, it will be replaced in-kind. Any damage to existing improvements will be repaired in a manner comparable to its existing condition. It is understood that the Grantee agrees to indemnify, defend and hold the Grantor, its affiliates, employees, agents, successor and assigns, harmless against any 'and ail damage, cost and liability imposed or claimed, including atomep's fees and other expenses, arising directly or indirectly from any act or failure of the Grantee or Grantee's agent(s), . contractor(s), or employees to act, including all claims related to the injury or death of any person or damage to any property resulting from the Grantee's negeligent use of said real property. This temporary construction easement shall remain m force for a period one year from the date that this document is recorded or upon the completion of the La Costa Avenue roadway widening improvements, whichever date occurs first.
