L. FRANK, JR., married men, as our separate property, and FAWCO, a partnership, Grantors, of the City of Los Angeles, County of Los Angeles, State of California, owners of the hereinafter described lands, for and in consideration of One and OO/lOO Dollar ($1.00) to us in hand paid by the City of Carlsbad, County of San Diego, State of California, or on its behalf, the receipt whereof is hereby acknowledged, and the benefits to accrue to us, by reason of the loca- tion and establishment by the City of Carlsbad, of a public highway upon, over and across said lands, we do hereby signify our approval of and consent to the location, establishment and construction of such highway thereon, and we do, by these presents hereby grant, convey and dedicate to the CITY OF CARLSBAD, State of California, Grantee, the right of way and incidents thereto for such public highway upon, over and across the said lands, hereinafter described, lying and being in the City of Carlsbad, County of San Diego, State of California, and particularly described as follows, to-wit: 1 Those portions of Section 32, T. 11 S. , R. 4W. , S. B. &M., described in deeds to Bernard Citron, et al. , recorded January 25, 1965, as Document No. 13574 and as Document No. 13575 in the Office of the County Recorder of said County, lying within a strip of land 126 feet wide, 63 feet each side of the following described center line : BEGINNING at a point on the northwesterly line of Rancho Agua Hediont according to Partition Map thereof No. 823, on file in said Recorder's Office, distant thereon N. 32°57*03ffE. 1970. 22 feet from the most northerly corner of Thum Lands, according to Map thereof No. 1681, on file in said Recorder's Office, said point having coordinates N. 368, 219.076 and E. 1,671,477.191 per California Coordinate System, Zone 6; thence N. 39°41'56frW. 169.58 feet to the beginning of a tangent curve to the right having a radius of 2500 feet; thence northerly along said curve through a central angle of 35°10t58rf a distance of 1535.14 feet; thence tangent to said curve, N. 3°09t03"W. 527. 37 feet to a point on the southerly line of State Highway XI-SD-78 distant thereon S. 86°50*57r1W. G%.ankors hereby grant to the City of Carlsbad, County of San Diego, State of California, the privilege and right to extend and maintain embank- ment slopes at a ratio of 1-1/2 horizontal to 1 vertical, excavation slopes at a ratio of 1 horizontal to 1 vertical, and drainage structures beyond the limits of said adjacent public highway, where and to the extent require for the support, drainage and maintenance of said public highway, over and across the lands owned by Grantors adjacent to said public highway, lying and being in thecity of Carlsbad, County of San Diego, State of California, and particularly described as follows, to-wit: Those portions of Section 32, T. 11S., R. 4W. , S. B. B. &M., described in deeds to Bernard Citron, et al., re- corded January 25, 1965, as Document No. 13574 and as Docu- ment No. 13575 in the Office of the County Recorder of said County, RESERVING unto the Grantors and subsequent owners of said adjacent lands, on which such slopes or drainage structures shall be situated, the right at any time (a) to remove such slopes, drainage structures or portic thereof upon removing the necessity for maintaining such slopes, drainag structures or portions thereof, or (b) upon providing in place thereof other adequate lateral and subjacent support, the design and construction of which shall be first approved by the City of Carl'sbad, in the County of San Diego for the protection and support of said highway.
