the State of California, with its principal office at Carlsbad, S'
California, hereinafter called second party,
That the first party, for and in consideration of Ten
($10.00) Dollars and other good and valuable considerations to
them in hand paid by the second party, the receipt whereof is
hereby acknowledged, do by these presents grant, bargain, sell,
convey and confirm unto the second party, and to its successors
and assigns, the right, right of way, easement and privilege to
lay, build and maintain on, in, under, and/or across the here-
inafter described real property, for the purposes of conveying
water, one or more pipe lines, together with the right of in-
gress to and egress from said real property for the purpose of
making surveys, locating, putting down, constructing, placing,
replacing or reconstructing in the same or any other position
therein or thereon, maintaining, operating, connecting with and/or
repairing any and all of the above-mentioned items, and for all
other purposes that are or may be or become necessary and inci-
dental to the construction, reconstruction, placing, replacing,
maintenance and/or operation of any and all of said items,
The above mentioned real property is described as fol-
lows 8
+ An easement for water service situated in Lot 2 of Section 31, T-114, R-44, San Bernardino Heridian, in the County of San Diego, State of California, ac- cording to United States Government Survey approved Dec. 27, 1870, over a strip of land, 25 feet in width, the center line of said strip being described as fol- lows :

Commencing at the intersection of the center line of Vista Way (Wall Street) with the center line of Moreno Street as shown on Map of Hotaling Lands, according to Map thereof No, 1717 filed in the of- fice of the County Recorder of said San Diego County, April 16, 1921; thence M54048'E along the said cen- ter line of said Vista Way (Wall Street) and its Northeasterly prolongation in said Lot 2 of Section 31 a distance of 1669.20 feet to the true point of beginning; thence S44°53130t%, 1483.90 feet , more or less, to an intersection with the Southerly boun- dary of said Lot 2 of Section 31, said boundary be- ing shown as a portion of the Northerly boundary of Tract 1 of Laguna Mesa Tracts according to Yap there- of No. 1719 filed in the office of the County Recorder of said San Diego County, June 20, 1921, said point of intersection bein distant thereon rS880301W (record Ab 88°34103i1W) , 55.8t feet from the Southeasterly cor- ner of said Lot 2 of Section 31; said easement to begin in the center line of said Vista Way (Wall Street) and terminate in the Southerly boundary of said Lot 2 of Section 31.
This grant is made subject to the following covenants
and conditions on the part of the second party, its successors
and assigns, to be by them kept and performed, viz:
1st. That upon the permanent removal from said pre-
mises by the second party, its successors and assigns, of all
of the above mentioned items and equipment, the right to remove
which is hereby granted, the surface of the ground shall be re-
stored as nearly as possible to its present general condition,
2nd. That the placing, construction, reconstruction,
maintenance, operating and repairing of any and all of said
items and equipment shall be done so as to interfere as little
as possible with the above described real property by the first
party; that the surface grade of said property shall not be
changed by first party subsequent to the commencement of con-
struction work by second party; and that first party shall carry
on their operations of said real property in such manner as not
to damage or interfere with any of the equipment at any time
placed,constructed, maintained or used thereon by the second
party, its successors and assigns.
