described as follows:
Beginning at a point on the South line of said Tract 238, distant 1Uorth
63°44t20'p East 50 feet from the Southwesterly corner of Tract 238;
Thence North .28"39' Yest parallel with the westerly line of said Tract
238 @ distance of 675.72 feet;
Thence South 6~21' West parallel with the Northerly line of Tracts 233
and 238 a distance of 365.81 feet;
Thence South 28O39' East parallel with the westerly line of Tract 238,
a distance of 616.01 feet to a point on the southerly line of said Tract
.233 ; Thence along said southerly line of Tract 233, PJorth 72O25' East a dis-
tance of 294.38 feet to an angular point of said southerly line;
Thence continuing along said southerly line of Tracts 233 and 238, North
63°44'20rr East a distance of 76-92 feet to the point of beginning.
Excepting therefrom that portion of the above described land that has
been conveyed to the State of California,
The center line of said right of way easement in the aforesaid land is particularly described as
foIIows:
Beginning at a point on the Ves.terly'line of the above described ,prop-
erty North 28°42'52" Vest (Deed Florth 28O39' Vest) a distance of 4q5.62
feet from the most southwesterly corner thereof;
Thence from said point of beginning North 8$'78'@'* East a distance of

Thence iVorth 81°07r00"' East a distance of 34,64: feet, more or less, to a
point on the westerly line of the property owned by the State of Calif-
ornia, said point being Piorthwesterly along the Vest-erly line of said
State of California property a distance of 354.19feet from the southerly

w " . - It is understood and agreed by the parties hereto that the easement herein described is granted as a peq
easement for the purpose of erecting. constructing, reconstructing, replacing, repairing, maintaining, and operating
system, sewerage, drainage, power line, excavation, and/or embankment facilities and appurtenances thereto, together
the right of ingress and egress to and from said right of way by practical route or routes in, upon, over, and acios
aforesaid lands, together with the right to clear and keep ciear said right of way from LuiIdings,, structures, trees
brush, and any similar surface or subsurface encroachment which may interfere with reasonabIe and proper use o
right of way easement. The Grantor and successors in estate of the aforesaid lands hereby agree to neither permit nor
or construct any building or structure, plant any tree, or otherwise create or permit any encroachment which may int
with reasonabIe and proper use of the said right of way easement by the Grantee.
Grantor also grants the City of Carlsbad the right to use for
construction and grading purposes a strip of land 20 feet in
width that is northerly and that adjoins the easement here-
in described.
