NO TRA;VSER T"4X DUE 3/8L 4 < IJO RF,C,CORDLVG FEE REQTJIRE'3: THIS DOCUMENT EXEMPT FROM FEE PURSUANT TO SECIlON 6103 OF CALIFORNIA GOVERNMENT CODE MPORARY CONSTRUCTION and SLOPE EASEMENT Assessor's Project: Poinsettia Lane & 1-5 Interchange Widening Parcel Parcel No.: R/W 03HARB104HARB NO: APN 214-501-59160 FOR A VALUABLE CONSIDERATION, receipt of which is hereby acknowledged, HARBOR POINTE HOMEOWNERS ASSOCIATION, a California Nonprofit Mutual Benefit Corporation hereby GRANTS to THE crry OF CARLSBAD, A MUNICIPAL CORPORATION, a temporary construction and slope easement for the purpose o€ dtermg the existing slope grade and removing an existing wall and landscaping and rqlaeing same with like kind improvements in connection with the widening and reconstruction of Poinsettia Lane and the OFF-RAMP for NORTH-BOUND 1-5 and any and all appurtenances thereto, over, under, along and across the hereinafter described property, together with the right to convey said temporary construction easement, or any portion of said easement, to other public agencies. The real property referred to hereinabove and made subject to said temporary construction easement by this grant is situated in the City of Carlshd, Cour:?y of San Diego. State of California, and is more particularly described in the attached Exhibits "A-2" and "A-4" and as shown OR the attached Exhibits "B-2" and "B-4": The Grantee agrees that it shall be responsible for the restoration of the premises to the condition existing prior to entry, as nearly as possible. That portion of the existing wall, landscaping and related irrigation system subject to removal will be replaced with like kind improvements. Any damage to existing improvements resulting from removal or reattachment will be repaired in a manner comparable to its existing condition. It is understood and agreed that the Grantor shall not be held liable for any damage to equipment or injury to personnel of said Grantee, its agents, contractors, or employees resulting From the Grantee's temporary use of said id property. This temporary construction easement shall terminate or expire on December 31, 1995, or upon the completion of the construction, whichever occurs first. Completion of construction will be that date established by the filing of a NOTICE OF COMPLETION with the San Diego County Recorder. Upon the conditions hereinabove recited, the City of Carlsbad or its successor in interest shall quitclaim all of its right, title and interest in this temporary construction easement upon receiving a written request from the GRANTOR or its successor in interest.
