as Joint Tenants , the Grantor, does hereby grant to the City <
of CarIsbad, the Grantee, a right of way easement five feet ( 5 ' ) in width,
in, upon, over, and across the following described lands, to wit:
That portion of Lot 1 in Section 1, Township 12 South, Range 5 West,
San Bernardino Meridian, in the City of Carlsbad, County of San Diegc
State of California, according to United States Government Survey
approved June 22, 1883, described as follows:
I Commencing at the,intersection of the East line of said Lot 1 with tl
North line of Lgggus- Dri-ve_ as shown on Map No. 1722 of Seaside Lands
filed in the Office of the Recorder of said San Diego County, July 2:
1921; thence North 89O 50' West along said North line of Laguna Drivi
495.00 feet to a point on the West line of land conveyed to Alexande
Beller by deed dated March 30, 1916 and recorded in Book 708, page 71
of Deeds, said point being the TRUE POINT OF BEGINNING; thence conti
uing North 89' 50' West along said North line of Laguna Drive, 169.0
feet to the Southeast corner of land conveyed to Willis James Carpen
by deed dated January 7, 1952 and recorded in Book 4345, page 547 of
Official Records; thence North Oo 05' East along the East line of sa
land, 256.00 feet to a point on the Southerly boundary of Buena Vist
Gardens, as shown on the Map thereof No. 2492, filed in the Office o
the Recorder of said San Diego County, August 4, 1948; thence South
89O 50' East along said Southerly boundary, 169.00 feet to the afore
mentioned West line of land conveyed to Beller; thence South Oo 05'

to the TRUE POINT OF BEGINNING: thence continuing North 89O 50' West
10.00 feet along said North line of Laguna Drive; thence North Oo 10
