by and between BOY F, UNESOW and LILLIAN KO LElorJOI, husband
and wife, hereinafter called first party, and CMLSBAD
MUTUAL WATER COWMJY, a corporation organized and existing
under the laws of the State of California, with its principal
office at Cdlsbad, California, hereinafter called second party
WITNESSETH
That the first party, for and in consideration of Ten
($10.00) Dollars and other good and valu8ble consideration to
them ~IB hand paid by the second party, the receipt of which
is hereby acknowledged, does by these presents grant, bargain,
sell, convey and confirm unto the second party, and to its
successors and assigns, the right, right of wag, easement and
privilege to lay, build and saintain on, in, under, over, and/or
across the hereinafter described real property for the purpose
of conveying water, one or more services md pipe lines,
together with the right of ingress to and egress from said
real property for the purpose of making surveys, locating,
putting down, constructing, placing, replacing or reconstructing
in the same or any other position therein or thereon, maintain-
ing, operating, connecting with and/or repairing any and all of
the above mentfoned items, and for all other purposes that are
or may becone necessary and incidental to the construction, re-
constmction, placing, replacing, maintenance and/or operation
of any and all of said itens on the rester4 10 feet of the
following described propertyt
"That portion of Cedar Hill Addition to the Town of Carlsbad, in the County of San Diego, State of California, according to Bdap thereof No. 532, filed in the office of the Recorder of said San Diego County, April 25, 3.888, described as follows: Beginning at the ICE corner of said Cedar Hill Addition, running thence H89026'W along the N line of said Addition, 731.29 feet to the 1oE corner of Tract 6 of Laguna Mesa Tracts, as shown on Map thereof Bo. 1719; thence S along the E line of said Tract 6, a distance of 1097.40 feet to the E% corner of that parcel of land described in deed to Clarence K Brodie, et ux, recorded Oct. 19, 1945, in Book 1971, page

164 of Official Records, said point being the true point of beginning of the property herein described; thence E along the
S line of said Brodie's land, being along a line parallel with the S line of said Cedar Hill Addition, a distance of 366 feet to a point on the W line of the land described in deed to E. Bo Satton ex ux recorded Octo 5, 1944 in Book 1754, Page 175 of Official Records; thence S parallel with the E line of said Tract 6, being along the W line of said Sutton's land a distance3 of 119 feet; thence 911 along a line parallel with the S line of said Cedar Hill Addition, a distance of 366 feet to a point on the E line of said Tract 6; thence N along said E line a dis- tance of 119 feet to the true point of beginning.
This grant is made subject to the following covenants and
conditions on the part of the second party, its successors and as-
signs, to be by them kept and performed, viz:
1st. That upon permanent removal from said premises by the
second party, its successors and assigas, of all of the above
mentioned items and equipment, the right to remove which is hereby
granted, the surface of the ground shall be restored as nearly as
possible to its present general condition.
2nd. That the placing, construction, reconstruction, main-
tenance, operatiw and repairing of any and all of said items and
eqniplPsent shall be done so as to interfere as little as possible
with the agricultural use and cultivation of the above described
real property by the first party; that the surface grade of said
party shall carry on their operatiow of said real property in
ouch mamer as not to damage or interfere with any of the equipment
at any time placed, constmcted, maintained or used thereon by the
second party, its successors and assigns.
