EASEMENT
For valuable consideration, receipt whereof is hereby acknowledged,
I I George W. Losa, a married man,
, the Grantor, does hereby grant to the City
of CarIsbad, the Grantee, a right of way easement Ten feet ( 10.00') in width,
in, upon, over, and across the foIIowing described lands, to wit:
That portion of Tract 237 of the Thum Lands, in the City of Carlsbad,
County of San Diego, State of California, according to Map thereof No,
1681, filed in the office of the Recorder of San Diego County, Decem-
ber 9, 1915, described as follows:

Beginning at the intersection of the Southeasterly line of said Tract
No. 237, with a line drawn parallel with and 644.3 feet Westerly
(measured along the center line of Chinquapin Avenue) from the center
line of Adams Street, as shown on said Map; thence North 28O 39' West
118.06 feet to the TRUE POINT OF BEGINNING; thence continuing North
28O 39* West 257.68 feet to a point in the Northwesterly line of the
Southeasterly half of said Tract 237; thence along said Northwesterly
line South 61° 21' West 9.75 feet to a point in the E.asterly line of
State Highway Survey XI-SD-2, said point being on the arc of a curve
concave Easterly and having a radius of 1960 feet, a radial line to
said point bearing South 75O 57' 37" West; thence Southerly along the
arc of said curve an arc distance of 200.12 feet; theme tangent to
said curve South 19O 53' 22'' East 63.0 feet; thence North 60° 54' 38"
East 59.42 feet to the TRUE POINT OF BEGINNING.
The center Iine of said right of way easemen{ in the aforesaid Iand i:; particuIarIy described as
follows:
Commencing at a point in the center line Chinquapin Avenue, dis-
tant thereon South 61° 21' West 644.30 feet from the intersection of
said center line with the center line of Adams Street, as said Avenue
and Street are shown on said Map No, 1681; thence North 28O 39' West
400.74 feet to the TRUE POINT OF BEGINNING; thence South 61O 21' West
11.05 feet to a point in the Easterly right of way line of Pi0 Pic0
Drive, formerly known as a portion of State Highway Survey XI-SD-2,
said point being the Westerly terminus of said center line of said
easement .

It is understood and agreed by the parties hereto that the easement herein described is granted as a perp
easement for the purpose of erecting, constructing, reconstructing, repIacing, repairing, maintaining. and operating 7
system, sewerage, drainage, power Iine, excavation, and/or embankment faciIities and appurtenances thereto, together
the right of ingress and egress to and from said right of way by practicaI route or routes in, upon., over, and across
aforesaid Iands, together with the right to dear and keep ciear said right of way from buildings, structures, trees
brush, and any simiIar surface or subsurface encroachment which may interfere with reasonabIe a.nd proper use of
right of way easement. The Grantor and successors in estate of the aforesaid Iands hereby agree to neither permit nor
or construct any budding or structure, plant any tree, or otherwise create or permit any encroachment which may intf
with reasonabIe and proper use of the said right of way easement by the Grantee.
