TEMPORARY CONSTRUCTION EASEMENT
FOR A VALUABLE CONSIDERATION, receipt of which is hereby acknowledged,
NEW ENGLAND MUTUAL LIFE INSURANCE COMPANY, A MASSACHUSETTS CORPORATION
hereby GRANTS to
THE CITY OF CARLSBAD, A MUNICIPAL CORPORATION,
a temporary construction easement for the purporse of operating constuction equipment and vehicles; for th temporary storage of building materials and equipment necessary for the reconstruction of the ON-RAMP for SOUTH- BOUND 1-5 and any and all appurtenances thereto, over, under, along and across the herenafter described property, together with the right to convey said temporary construction easement, or a] portion of said easement, to other public agencies.
The real property referred to hereinabove and made subject to said temporary construction easement by this grant is situated in the CITY OF CARLSBAD, COUNTY OF SAN DIEGO, STATE OF CALIFORNIA, an is more particularly described in the attached EXHIBIT "At as shown on the attached EXHIBITS "B":
The GRANTEE agrees that it shall be responsible for the restoration of the premises to the condition existing prior to
entry, as nearly as possible. If the existing landscaping and the related irrigation system is damaged, it will be
replaced in-kind. Any damage to the existing concrete block wall will be repaired in a manner comparable to its
existing condition.
This temporary construction easement shall terminate upon the completion of the City contract therefore, said date as
established by the filing of a NOTICE OF COMPLETION with the San Diego County Recorder, or two (2) years from
the date of recording this instrument, whichever date occurs first. Upon the conditions hereinbefore recited, the CITY
OF CARLSBAD or its successor in interest shall quitclaim all of its right, title and interest in this easement upon
receiving a written request from the GRANTOR or its successor in interest.
The construction of the proposed improvements shall be completed in accordance with the City's Improvement Plans
Drawing No. 326-7 and as more specifically shown on the following drawings:

(2) Planting Plan HPI - HP3
(3) Irrigation Plan HP7 - HP9
(4) Contour Grading Plan GI -G2
(5) Summary of Quantities Q1
(6) Layout Plan L1 - L2

Hedionda, in the City of Carlsbad, County of San Diego, State of California, according to
Map No. 823, filed in the office of the County Recorder of San Diego County, November
16, 1896, and recorded September 16, 1988, as File No. 88-467980 of Official Records.
BEGINNING at the northwesterly corner of said Parcel 1;
Thence South 77'34'39" East 4.73 feet to the beginning of a non-tangent curve,
concave to the North, having a radius of 2557.42 feet, to which a radial line bears South
07 O 34'23" West;
Thence easterly 20.31 feet along said curve through a central angle of 0'27'18" to the
POINT OF BEGINNING, to which a radial line bears South 07"07'05" West;
