SAN DLEGO GAS & ELECTRIC COWANY, a corporation, as Grantor, for and in
consideration of the sum of Ten Dollars, and other valuable consideration, does
hereby grant to the City of Carlsbad, a municipal corporation, hereinafter call(
Grantee, its successors and assigns, an easement in, upon, under and across the
hereinafter described lands, to erect, construct, reconstruct, replace, repair,

maintain and use a sewer pipeline, with all necessary equipment and appurtenanc
thereto, together with the right of ingress thereto and egress therefrom, by a
practical route, over and across that portion of the Grantor's lad situate in
the City of Carlsbad, County of San Diego, State of California, more particula
de scribed as follows : % That portion of Lot ltH1t of Rancho Agua Hedionda, according to Partition Map thereof No. 823, filed in the office of the
Cotmty Recorder of 3a.n Diego County, November 16, 1896,
described in a Deed to San Diego Gas & Electric Company, a corporation, dated September 23, 1948, and recorded October 8, 1948, in Book 2974 at page 493 of Official Records of said County of San Diego, excepting therefrom that certain portion thereof described in a Deed recorded in Book 4722 at page 359 of said Official Records, said easement being more
particularly described as follows:
lying 5.00 feet, measured at right angles on each side of the f ollawing described center he:
Commencing at an angle point in the Southwesterly
boundary line of the above described San Diego Gas & Electric
Gompany1s land, said point being the most Northerly corner
of Lot 20 of Tierra Del Oro, according to the Map thereof Bo, 3052, ,filed in the office of the Recorder of said County
of Sa Diego, said point being also a point in the arc of
a 5298.73 foot radius curve concave Northeasterly, a radial line of said curve passing through said point bears South 59" 541 50. Nest; thence Southeasterly along the Southwesterly boundary ,line of said San Diego Gas & Electric Canpany* s
land, being the Northeasterly line of said Lot 20 and the arc
of said cm through a central angle of Oo~ 331 4O", a distance
of 51.88 feet to an 8n x 8n concrete monument with. a copper
center, said monument - is set in the Southwesterly boundary line of Carlsbad Boulevard (formerly United States Highway 101,
State Highxay Route XI-SI-243) opposite Engineer1 s Center Line
Station 352 plus 12.40; $hence North 59' 21' lW-East, along
a radial line of said curve, a distance of 100.00 feet to a
point in the Mortheasterly line of said Carlsbad Boulevard;
thence South 30" 381 50" East, along said Northeasterly line,
a distance of 33,88,.feet to a point, which said point is the
TRUE POINT OF BEGINNING of the center line of the easement herein described;.thence from said TRUE POINT OF BEGINNING, North 4Q0 441 35" East, a distance of 76.33 feet.

The side lines of the above described easement shall be
prolonged or shortened so as to terminate in the Northeasterly
boundary line of said Carlsbad Boulevard,
Grantee covenants for itself, its successors, assigns and agents tnat all
work in connection with the installaticn and/or maintenance of the sewer pipeli
and its appurtenances shall be done in a workmanlike manner and in accordance
with standard engineering practices, and Grantee, its successors, assigns or
agents shall be responsible for any danage to Grantors s existing or future
facilities, including landscaping, occasioned by or arising from the constructi
and/or maintenance of said sewer pipeline within said Grantor* s property.
Grantor reserves unto itself, its successors and assigns, the right to use
the subsurface, surface and airspace thereaver, of the hereinbefore described
sewer pipeline easement for t'ae installation of such facilities as it shall now
or in the future deem necessary, provided, however, that such reserved use righ
shall not be exercised by the Grantor, its successors or assigns, in such manne:
as to be incompatible with the rights herein granted.
Grantee agrees that if for any reason said easement is abandoned by said
Grantee for a continuous period of one (1) year, then all rights herein granted
shall revert to the Grantor, its successors or assigns, automatically and with01
the necessity of re-entry or notice.
San Diego Gas & Electric Company hereby covenants and declares in accordanc
with the Public Utilities Act of the State of California, that the properky
hereinabove described is not necessary or useful in the performance of its dutit
to the public, and it is not needed for or useful in the conduct of its business
