day of September, 1 9 1 4, by and between Emily U. Arguello

of Oceanside, County of San Diego, State of California, parties
of the first part, and SOUTH COAST LAND COMPANY, a corporation,

party of the second part, Y/ITNESSETH:
That for and in consideration of the sura of Two Hundred
Fifty Dollars ($250.00), cash in hand paid by second party to
first parties, receipt whereof is hereby acknowledged by first
parties, together with other good and valuable considerations,
first parties do hereby grant to second party, and to its suc-
cessors and assigns, the right, easement and privilege to lay,
build and maintain a viaduct, conduit or pipeline for the convey
-ing of water, either by means of pipe laid underground or by
means of pipe or flume resting on wooden, metal or cement
trestles, under across or over the following described real
property, situated in the County of San Diego, State of Califor-
nia, to-wit:

Lot Two (2), Section Thirty-one(31), Township
Eleven(ll), South, Range Four (4), West, S.B.M.
Said viaduct, conduit or pipeline to extend across
said premises in a general northerly and southerly direction,
a distance of one-haIf mile approximately, along a line to be
etermined by second party;
TOGETHER with the right of ingress and egress for
the purpose of making surveys, locating, putting down, construct
28 -ing, re-constructing, maintaining, operating, connecting with
29 and repairing said viaduct, conduit or pipeline, and for all
30 other purposes that are or may be or become necessary and in-
cidental to the construction, maintenance and operation of
said viaduct, conduit or pipeline.
This grant is made subject to the following covenants
and conditions on the part of second party, its successors

arid assigns to be kept and performed by them:
1st, That said second party, its successors and assigns,
may at any time remove said viaduct, conduit, pipeline or
trestlework from said premises and leave the surface of the
ground in as good condition as before;
2nA, That said viaduct, conduit, pipeline or trestle-
work shall be so constructed as to interfere as little as
possible, consistent with good engineering, with the use and
cultivation of the land hereinabove described, and said parties
of the first part shall have at all times, the right to use
and cultivate the said land for the usual purposes of agri-
culture, cultivating or using, however, on the said land, nothirg
that will damage or interfere with said viaduct, conduit, pipe-
line or trestlework.
3rd, Said first parties reserve the right to cross and
re-cross the said waterline with water ditches, pipes or
pipelines for the purpose of carrying water, or for draining
the property herein described, PROVIDING HOWEVER, that all
suchmter or drainage pipelines or ditches which may be con-
! structed by said parties of the first part shall not interfere
!in any way with the viaduct, conduit, pipeline or trestlework
of said party of the second part.

cuted this instrument, by due authority, this day of
