"BE IT RESOLVED that the President and Secretary of
of the Corporation be authorized empowered and
directed to accept the following Easement on hehalf
of the Company, and to have same recorded in the
County Recorder's Office in San Diego:
UNION TITLE INSURANCE and TRUST COMPANY
San Diego, Calif."
I HEREBY CERTIFY that the above is a true
and correct copy of the Minutes of the meeting of the
Board of Directors of Carlsbad Mutual Water Company, held
in the office of the Company in the Town of Carlsbad,
County of San Diego, State of California, on Tuesday,
May 17, 1949.

9 EASEMENT
UNION TITLE INSURANCE AND TRUST COMPANY, a corporation,
of the County of San Diego, State of California, for and ------
in consideration of One ($1.00) Dollar, and other value received,
do grant the CARLSBAD MUTUAL WATER COMPANY, a corporation, organized
under the laws of the State of California, the perpetual right and
easement for pipe line purposes over a strip of land of the uniform
width of five feet lying two and one-half feet on either side of the
following described center line, being over that portion of Lot 3 in
Section 1, T-12-S, R-5-W, San Bernardino Base and Meridian, in the
County of San Diego, State of California, according to United States
Government Survey thereof, approved June 22, 1883, described as fol-
lows:
Beginning at the intersection of the center line of Pacific
Street as said Street is shown on Map No. 909 of Ocean Front
Addition on file in the office of the County Recorder of said
San Diego County, with the North line of said Lot 3; thence
South 41« 16* East along the Southerly prolongation of said
center line of Pacific Street, 225.24 feet to the beginning
of a tangent curve concave Northerly and having a radius of
75*39 feet; thence Southeasterly along the arc of said curve
an arc distance of 100.00 feet to a point of compound curvature
with a curve concave Northwesterly and having a radius of 1432.30
feet a radial line to said point of compound curvature bearing
South 27® 16» East; thence Northeasterly along the arc of said
curve an arc distance of 65.30 feet to the true point of beginn-
ing^ a radial line to said point bearing South 29® 52» 43«» East;
thence, from said true point of beginning. South 29® 58* 43"
East, 223.20 feet, along a line which is parallel with and dis-
tant Northwesterly measured at right angles, 2.50 feet from the
Southeasterly line of Lots 38 and 28 as shown on Assessor's
Map No. 46, said San Diego County, approved by the Board of
Supervisors of said County, February 14, 1938; thence South
15** OV West, 64.80 feet; thence South 13® 59* Bast, I38.OO
feet; thence South 38® 59' East, I78.OO feet; thence South 28®
39* East, 225.00 feet; thence South 31** 56* 50" East to a point
in the Southerly line of Lot 3 of said Section 1 being the
Southerly terminus of said easement;
TOGETHER with an easement for pipe line purposes of the uni-
form width of five feet lying two and one-half feet on either
side of the following described center line:
Beginning at the Northerly terminus of that certain above de-
scribed course having a bearing of South 31® 56' 50" East;
thence South 31^ 56' 50" East, along said line. 293.00 feet
to the true point of beginning; thence South 58® 03* 10" West,
140.00 feet, more or less, to the existing Carlsbad Mutual
Water Company pipe line,
to be used for the purpose of placing, constructing, reconstructing,
repairing, and maintaining, and using pipe, and fitting thereon; and
the transmission of water for all purposes for which it may be used,
and also the perpetual right to replace said pipe and fittings, and
maintain the same in a suitable and proper condition for use. It
is agreed by the parties hereto, that the aforesaid rights are here-
by granted.
The said Corporation is to be responsible for any damages
that may be caused by constructing, operating, and maintaining all
said pipe and fittings upon said land for which in law it would be
liable ,
TO HAVE AND TO HOLD all such rights and easements unto the
said Corporation its successors and assigns forever.
IN WITNESS WHEREOF we have hereunto set our hand and seal
this 15th day of May, , 1949,
