GRANT DEED OF PUBLIC WATER EASEMENT
FOR VALUABLE CONSIDERATION, receipt of which is acknowledged, I, The Knolls of Calavera Hills Homeowners
Association, a California nonprofit mutual benefit corporation, Grantor, does hereby grant to CARLSBAD
MUNICIPAL WATER DISTRICT, a Public Agency organized under the Municipal Water Act of 1911, and a
Subsidiary District of the City of Carlsbad, its successors and assigns, a public water easement.
PURPOSE: The public water easement granted herein is granted for the following purposes: the
construction, operation, repair, reconstruction and all activities necessary to construct, reconstruct, operate,
maintain and repair water facilities. Said facility may include pipelines designed to control the flow of water and all
facilities and structures associated with said use and protection of said facility. The use shall also include a means
of access to and from said facility for the purpose of constructing, operating, repairing, maintaining, inspecting and
reconstructing said facility.
Grantor herein agrees that no buildings and/or structures will be erected, walls constructed, fences built, nor
trees planted by it within the public water easement without the express written approval of the Grantee.
LOCATION OF THE EASEMENT: The easement granted herein is located within and upon the property
more particularly described in Exhibit "A". Exhibit "B" is attached for clarity only.
This deed is made and accepted subject to all encumbrances of record and specifically subject to the
Declaration of Covenants, Conditions and Restrictions for The Knolls of Calavera Hills Planned Unit Development,
recorded April24, 1986, as File/Page No. 86~158392 in the Official Records of San Diego County, and any

The Northeasterly 15.00 feet of the Southwesterly 30.00 feet of Lot "H" of Carlsbad Tract
No. 83-21 Unit No. 3, as measured perpendicular to the Southwesterly line thereof, in the
City of Carlsbad, County of San Diego, State of California, according to Map thereof No.
114 76, filed in the Office of said County Recorder on April 1, 1986.
Said parcel contains 4,333 square feet or 0.099 acre, more or less.
