an easement for sewer purposes over, under, upon, and across said real property together with
the right to construct, grade, inspect, operate, maintain, repair, replace and remove surface
improvements and features within the bounds of said easement as described in Exhibit “A”
consisting of 1 page, attached hereto and made a part hereof. Exhibit “B” consisting of 1 page
is attached for clarity only.

An easement for public sewer mains, appurtenances and utility purposes over,
under, along and across a portion of Lot 76 of Carl&ad Tract No. 96-02, in the
City of Carlsbad, County of San Diego, State of California, according to Map thereof No. 14060, filed in the Office of the County Recorder of said County on
October 27, 2000 described as follows:
Commencing at the Northeast comer of said Lot 76; thence along the
Southeasterly line of said Lot 76 South 20°49’45” West, 80.62 feet to the True Point of Beginning; thence continuing along said Southeasterly line South
20°49’45” West, 10.00 feet to the Northeasterly line of that certain 25.00 foot wide Public Utility Easement dedicated on said Map No. 14060; thence leaving
said Southeasterly line along said Northeasterly line North 70°19’12” West, 74.80
feet; thence leaving said Northeasterly line North 64’40’48” East, 14.14 feet;
thence parallel with said Northeasterly line South 70°19’12” East, 65.00 feet to
the True Point of Beginning.
Said easement contains 699 +/- square feet.

CERTIFICATION FOR ACCEPTANCE OF DEED
This is to certify that the interest in real property conveyed by the deed or grant
dated March 13, 2001, from Terraces at Sunny Creek, LLC a California limited liability
company, to the City of Carlsbad, a Municipal Corporation, is hereby accepted by the
City Council of the City of Carlsbad, California, pursuant to Ordinance No. NS-422,
adopted on September 16, 1997, and the grantee consents to the recordation thereof
by its duly authorized officer.
