hereby GRANTS to
City of Carlsbad, a Municipal Corporation
the following described real property in the City of Carlsbad, County of San Diego, State of
California:
an easement for General Utility and Access PURPOSES over, under, upon and across said real
property as described in Exhibit “A consisting of one (1) page, attached hereto and made a part
hereof. Exhibit “B” consisting of two (2) pages is attached for clarity only.

That certain parcel of land situated in the City of Carlsbad, County of San Diego, State of
California, being that portion of Parcel 1 of Lot Line Adjustment ADJ 04-09, recorded
September 30, 2005 as Instrument No. 2005-0850715, in the Office of the County Recorder of
said San Diego County, described as follows:
BEGINNING at the most westerly comer of said parcel; thence along the westerly line of said
parcel South 40'08'09" East 43.51 feet and South 16'14'14'' East 14.21 feet; thence leaving said
westerly line North 72'39'28" East 99.76 feet; thence North 17'20'32" West 22.08 feet to a point
on a non-tangent curve concave southerly and having a radius of 190.00 feet, a radial line of said
curve from said point bears South 12'51'28'' East; thence along said curve easterly 57.00 feet
through a central angle of 17'1 1'23"; thence non-tangent from said curve South 77'20'30'' East
136.59 feet to an intersection with the easterly line of said parcel; thence along said easterly line

CERTIFICATION FOR ACCEPTANCE OF DEED
This is to certify that the interest in real property conveyed by the GRANT
DEED OF EASEMENT dated October 19, 2005, from The Bav Collection
Homeowners Association, to the City of Carlsbad, California, a municipal
corporation, is hereby accepted by the City Council of the City of Carlsbad,
California, pursuant to Ordinance No. NS-422, adopted on September 16, 1997,
and the grantee consents to the recordation thereof by its duly authorized officer.
