FOR A VALUABLE CONSIDERATION, receipt of which is hereby acknowledged,
JAMES S. UKEGAWA, A MARRIED MAN AS HIS SOLE AND SEPARATE PROPERTY
hereby GRANTS to the
City of Carlsbad, a Municipal Corporation,
an easement for public street and public utility purposes over, under, upon and across the following
described real property which is situated in the City of Carlsbad, County of San Diego, State of
California, as described in Exhibit “A” consisting of two (2) pages, attached hereto and made a part
hereof, and as shown on Exhibit “B” consisting of one (1) page is attached for clarity only.
The Grantor understands that the present intention of the Grantee is to construct and maintain a
public highway on the easement hereby conveyed and the Grantor, for the Grantor’s successors and
assigns, hereby waives any claim for any and all damages to grantor’s remaining property contiguous
to the property hereby conveyed by reason of the location, construction, landscaping or maintenance
of said highway.
(As used above, the term “Grantor” shall include the plural as well as the singular number.)

This is to certify that the interest in real property conveyed by the Grant Deed of
Easement, dated June 22, 1999 from JAMES S. UKEGAWA, a married man as his sole
and separate property, to the CITY OF CARLSBAD, a political corporation and/or
governmental agency, is hereby accepted by the undersigned officer or agent on behalf
of the City of Carlsbad, Californla, pursuant to authority conferred by Ordinance No.
NS-422 of the City of Carlsbad adopted on September 9, 1997, and the grantee
consents to recordation thereof by its duly authorized officer.
