GRANT OF TEMPORARY CONSTRUCTION EASEMENT
FOR A VALUABLE CONSIDERATION, receipt of which is hereby acknowledged,
JAMES S. UKEGAWA, A MARRIED MAN AS HIS SOLE AND SEPARATE PROPERTY
hereby GRANTS to the
CITY OF CARLSBAD, a Municipal Corporation,
an easement for temporary construction purposes associated with the construction of a public street,
embankment slope and incidents thereto, upon, over and across that certain real property hereinafter described
in Exhibit “A” consisting of one (1) page attached hereto and made a part hereof, and Exhibit “8” consisting of
one (1) page is attached hereto for clarity only.
It is understood and agreed that the Grantor(s) shall not be held liable for any damage to equipment or injury to
personnel of said Grantee, its agents or employees, in the performance of the work done within the temporary
construction easement as described herein.
This easement shall remain in force for a period of two (2) years from the date this document has been
recorded in the Office of the County Recorder of San Diego County. Upon the expiration of said two (2) year
period, the Grantee shall have no further rights or liability in connection with said temporary construction
easement.

. . . CERTIFICATION FOR ACCEPTANCE OF DEED
This is to certify that the interest in real property conveyed by the Grant of Temporary
Construction Easement, dated June 22, 1999 from JAMES S. UKEGAWA, a married
man as his sole and separate property, to the CITY OF CARLSBAD, a political
corporation and/or governmental agency, is hereby accepted by the undersigned officer
or agent on behalf of the City of Carlsbad, California, pursuant to authority conferred by
Ordinance No. NS-422 of the City of Carlsbad adopted on September 9, 1997, and the
grantee consents to recordation thereof by its duly authorized officer.
