RECITALS ; This agreement is nade with reference to the following
facts :
1. O'vMER wishes to divide certain property hereinafter referred
to as PROPERTY, owned by him., located in the City of Carlsbad,
County of San Die^o, State of California, rore particularly
.described on Exhibit A, attached hereto and by this reference
incorporated herein .
2. Installation at the present tir.<e of certain public improve-
ments alonn; the street frontage of PROPERTY, listed on lixnibit
B, attached hereto and by this reference incorporated herein,
would be impracticable.
COVHNAMTS: Now, therefore, it is nutually agreed as follows:
1. CITY approves OWNER'S proposed division of PROPERTY .an

temporarily waives the requirement that OWNEf? install those

PROPERTY listed on Exhibit B attached hereto,
2. Upon written demand therefor by CITY, O'.v'NER shall forthwith
