Tax NIL AGREEMENT PARTIES: The parties to this agreement are the City of Carlsbad, A Municipal Corporation of the State of California, hereinafter referred to as CITY; and PQNALD A. BRIGGS. JR. hereinafter referred to as OWNERS; and RICILARD E. GEYER, herein- after referred to as DEVELOPER. RECITALS: This agreement is made with reference to the following facts: 1. 2. 3. DEVELOPER is the developer of certain real property located in the City of Carlsbad, County of San Diego, State of California, particularly described as Carlsbad Manor, Unit No. 1, according to map thereof No. 55Q3 filed in the office of the County Recorder of the County of San Diego, State of California, onpct-, -14. i gfig OWNERS are the owners of all property surrounding said subdivision, on which any work mentioned in paragraphs 2 and 3 of the covenants hereof will be done; said proper ty is described on Exhibit A attached. DEVELOPER and OWNERS desire the CITY approve the final subdivision map of said subdivision. Subject to its other requirements, CITY shall approve 3 the filing of the final subdivision map of said subdivision. 4 2. OWNERS shall allow DEVELOPER to develop said subdivision 5 according to a grading plan to be approved by the City 6 Engineer of CITY, which said grading plan will include grading and the placing of embankment slopes and cut 8 slopes on OWNERS' property. OWNERS hereby agree to such proposed grading and agree to allow the maintenance of such embankments and cut slopes so long as necessary •^•^ for the support of properties located in said subdivision •^^ 3. OWNERS agree to accept runoff water from said subdivision ^'^ at locations shown on the grading plans of said sub- 14 division approved by the City Engineer of CITY and to •^^ waive any and all damages to OWNERS' property occasioned 16 thereby. 1'^ 4. OWNERS agree to dedicate for public street and right of 1^ ^^'ay purposes all portions of the cul de sac of Tamarack •^^ Avenue located in and adjacent to said subdivision. 5.
