B. B. ?c M., distant thereon North O0O6? West 390.00 feet from the Southeast corner of said Section 34; thence along the Northerly boundary of said Lot "L" North 89°43T40" VhSt 1323.83 feet to a point in the North and South center line of the Southeast Quarter of said Section 34; thence along said last mentioned line North 0°10'20" West 1363,4 feet; thence South 70°39* East 289.67 feet; thence North 6So4lT East 494.40 feet, thence North 53*33' East 240.75 feet3 thence North IO321 East 76.50.-, feet; thence NorXh 78*31* East 186.23 feet; thence South 35O29' East ZSO.I.& feet to a point in the East line of said Section 34; thence along said last mentioned line South 0°06* East 1676.30 feet to the point of beginnlng, con- taining 45.29 acres more or less. Subject to all taxes for the fiscal year 1930-31. Subject also to all conditions, restrictions, reservations, easements rights, and rights of way of record. Provided, however, that this conveyance is made and accepted and said realty hereby is granted upon the following expressconditions, restrictions, and covenants, hereinafter referred to as "Conditions" which shall apply to and be binding upon the said Grantee,itssuccessors and assigns, said con- ditions being as follows: 1. A restriction that at no place on said property shall there be established, located relocated or maintained any rock crusher, rock bunker or other equipment or appurtenances used in connection with any rock crusheI 2. There is hereby reserved to the Srantor, its silccessora or assign a right to enter the premises and remove any number of small oak trees whick may be then growing upon the praises, together with the right to dig around the roots of such trees and remove the same in the manner customarily used b nurserymen in handling trees of like sizes; also a right to be reserved in the Grantor, itssucoessors or assigns, to enter upon the land and cut there- from as many of the oak trees now growing thereon as the Grantor, Its succet or8 or assigns, may desire to cut, together with the right of ingress arid egress to the said property to remove said trees or wood that may be cut frc .% 1 0 0 I -7 I i laid treea; provided, however, that the work of removing andjar cutting trees upon the premises and/or the removal of cut trees and wood therefrom shall be 80 conducted as to interfere in no way with the work and project of the Grantee upon said property; and that such removal and cutting shall be campleted prior to the time when the Grantee shall be ready to submerge the said lands; 3. There is hereby also reserved to the Grantor, its successors or assigns, a right to construct and maintain a pier or lading place on the Northerly edge of the reservoir to be constructed and maintained by Grantee at a point between the Easterly and 3esterly boundary lines of the lands herein conveyed, to be selected by the said Grantor, its successors or assigns, also the right to constrict and maintain a gate through any fence which mag be established by the Grantee, and the right to maintain boats, not exeeeding four (4) in number, on said reservoir, and the right to fish therefrom and hunt thereon; provided, however, that such work shall be done at the expense of the said Grantor, its successors or assigna, and that said landing place shall not be used for cmercial puqoses, provided, that the rJ of the Grantor, its 811ccesaor8 or assigns, reserved herein shall not be so assigned or transferred as to be simultaneously enjoyed or exercised by more than two individuals vrith their bona fide personal guests and/or members of their families. Such reservation shall be subject to the powers of the State of California and the County of San Diego and all other competent public authority with respect to sanitary protection of reservoirs containing water used for domestic purposes, and in the event that such authority shall prohibi. the we of such reservoir for boating, fishing or hunting, no liability on the part of Grantee shall result therefrom. The conditions, restrictions and reservations herein set out shall be binding upon and shall pass to the heirs, successors and assigns of the re- spective parties hereto, and shall be enforceable by either party hereto, or its successor in interest, acainst the other party hereto, or its successor in interest.
