THIS INDENTURE made this 29th dag of January, 1913 be-
tween Charles E, Culver, of Los hgeles, California, first party, and
South Coast Land Company, a corporation, second party,
LITUESSETH: For and in consideration of the sum of Ten

'LIEREAS One Charles Forman and Kary A. Forman, his wife,
have heretofore deeded and conveyed, or entered into agreements bind-
ing them to deed and convey, certain fsieces or parcels of land situate
in said County of 8an Diego, State of California, hereinafter more
particularly described, and
YXERZAS each of Faid deeds of conveyance contains the
reservation next hereinafter set forth, and each of said agreements
to convey contains the provision that the deed of conveyance to be
executed pursuant to such agreement shall contain the same reservation,

"It is expressly understood? and agreed that water shall
not be developed on the land hereby granted by the grantee, heir&
successors, assigns or transferees, by artesian or smface r~ells, or
otherwise, to be used on other lmds, or in excess of the reqniremenf;s
of the lands hereby granted for irrigstion, domestic and stock ptirposes;
and if such developenent is made by said grantee, or by any other per-
son, then and in that case the amount of water developed in excezs of
the requirements described in this Egreement shgll become the property
of said graator, his heirs or assigns, and mg be sold leased or con-
veyed to other lands for sale, lease or use. And the aaid grantor re-
serves, excepts and retains for himself, his heirs and assigns, all
rights of way for laying and maintaining pipes, pipe lines and aque-
ducts over and across said premises, which now, or at any time here-
after m&y be reasonablg required to enable said grantor, his heirs,
or assigns, to take, collect, carry and conduct said excess, or sur-
plus waters to other lands, or to enable srcid grantor, his heirs or
assigns, to inspect, reyair and replace or alter, maintain, enjoy and
control, said pipe lines and aqueduct.
"And said grantor also reserves, exccpts and retains for
himself, his heirs and assigns, all the mater, both .surface and sub-
terranean of the San Luis Rey River and its tributaries, above the
intersection of the said San Luis Bey River with the viestern bouridary
of the Konserrate Rinch; together with the right to construct, main-
eain and operate, a darn or dams, across or in said river, or said
tributaries, or either, or any of them, and impound and reservoir the
waters thereof, both surface, - sub-surface, storm and ordinary floc;
Also the right to develop maters upon the lands now belonging to, or
hereafter acquired by the grantor, his heirs or assigns, above said
point of intersectian, either by tunnels or wells, with the right to
install and operate pumping plants thereoc; and the right to divert,
lead and conduct away a11 or any part of said water st any or all
such points to places within or without said water-shed, as the grant-
or, his heirs or assigns, may elect; and certain of the same also con-
tain a reservation of a right of way for railroad purposes wherever
desired,,through and across the land covered thereby, with the pro- over,
vision that in case a railroad is not built and in operation within
five (5) years from date thereof, then said reservation should be null
and void.''
BfJD WEREAS said Charles Porman and Xary A. Forman, his
v;ife, by a conveyance dated the 29th day of Hovember, 1912, recorded
in Book 587 of Deeds, page 192, 3ecords of said San Diego County,
California, did remise, release and forever quit-claim to Charles Z.
Culver, first party hereto, all the rights and interests so reserved
by them zs aforesaid;
HOTi THERZFFORZ, first party does hereby transfer, convey
and confirm unto second party, its successors and assigns forever, all
his right, title and interest in and to all such water, water rights,
rights of way, and other rights so reserved.
The pieces or parcels of land so deeded and conveyed by
said Charles Forman and Lary A. Porman, his rife, or which said Charles
Porman and Lary A. Porman, his wife, have agreed to convey, and as to

which the reservations hereinbefore set forth were made, are partic-

The first party does hereby transfer, release, remise,
quitclaim and convey unto the second party all the interest acquired

heretofore deeded to J, E. Smith the whole of that certain Yiarners
Ranch lying in said County of Sm Diego, together with all water
rights in oonneotion with and appurtenant to said raaoh. It is further
the intention of this indenture to convey to second party all of the
water rights of every kind and nature that first party now own8 in
the valley of the Ban Luis Rey River in said County of Ban Diego.
