TheCityManagerhasaskedmetorespondtoyourletter,dated November5, 1987 regardingagreementsthatareonfilewiththeCounty Recorder's Office dealing with the La Costa Hotel and Spa.
Thefollowingagreements,withtheexceptionofNo.2, CIJP-258(A),Sign, canbereleasedsimplybyenclosingacheckmadepayabletothe11Cityof Carlsbadtl in the amount of $9.00 for each agreement.

'. TheAgreementforNo. 2,theSignAgreement, canbereleasedassoonas anappropriate signpermitisobtainedandallthereguiredfeesarepaid. Throughsomeinadvertenterroronourpart, asignpermitwasneverissued. This is averysimplerequirement. Youwillneedtohavesomeonesubmitfor asignpermit, wewillsignitoffandcollecttheapprcpriatefees,andthenwe willreleaseyourPublicFacilitiesFeeAgreement forthatarea. Thatshould clearupallofthePublicFacilitiesFeeAgreementsthatareonfilewiththe City to be released.
Thefollowingthreeagreementscannotbereleasedatthistime.

2. AgreementtoPayFeesRequiredbyGrowthManagementSystem, datedApril13, 1987-Recorder'sFileNo. 87-299160, PC-587, Spa Exercise Room Addition, 1,720 square feet
3. AgreementtoPayIncreasedFeesforDevelopmentManagement System, datedFebruary21,1986-RecorderlsFileNo.86-082699, CUP-258, PC-85-336, 160 Hotel Units
TheseagreementsarearesultoftheCity's implementationoftheGrowth ManagementPlan. Allapplicationsthatweresubmittedsubsequenttothe adoptionoftheGrowthManagementPlanwererequiredtosignanagreement topayanyandallfuturefeesassociatedwiththeGrowthManagementPlan.
Therearetwo feesthatarekeepingtheseagreementsfrombeingreleased atthistime. First, isanidentifiedfee, whichisan jncDXWafrcm2.5to3.5' percentbasedonthepermitvaluationoftheconstructionthatocunredinthe recentadditionsandremodelingofthefacility. Thisoneparcentwillbebilled withinthenextthirtydays. Thesecondfee,whichhasnotyetbeen determined,isthecQnmercialandindustrialfairshareofexistingdeficiencies a inthesouthCarlsbadarea. Thesearecontiqentliabilities associatedwithal. applicants/developerswhosignedagreementstopayanyandallfuturefees. Theagreementwasamethodbywhichdevelopmentcouldoccurpriortothe establishmentoffees. Applicantswhochosenottosignthefuturefee agreements,wouldnotbeissuedanypermitsuntilallofthefeeswere establishedsothey~dpaytheirfairshaxetomitigatedeficienciesintheir ZoneorQuadrantoftheCity.
